Landscaping Plan Clause Samples
The Landscaping Plan clause outlines the requirements and standards for the design, installation, and maintenance of landscaping on a property. Typically, it specifies the types of plants, layout, irrigation systems, and timelines for completion, and may require approval of plans by relevant parties before work begins. This clause ensures that landscaping meets agreed-upon aesthetic and functional criteria, helping to prevent disputes and maintain property value.
Landscaping Plan. The Owner shall landscape the subject lands all in accordance with the Landscaping Plan annexed hereto and marked Schedule "D". The Owner further agrees to maintain such landscaping for so long as the buildings exist on the lands. Any topsoil removed from the subject lands during grading operations shall be stockpiled thereon in areas compatible for the reception of the same and the Owner covenants and agrees that it will not remove such topsoil from the boundaries of the lands without the approval of the Municipality. Any topsoil excavated but not immediately required for landscaping or for grading purposes shall be contoured and bermed to the satisfaction of the Municipality. Alternatively, the Owner, at its sole risk and expense, shall move such topsoil to such area within the Municipality as may be designated by the Municipality or, in the further alternative, the Owner shall, after receiving permission from the Municipality, at its sole risk and expense, remove such topsoil out from within the boundaries of the Municipality.
Landscaping Plan. The Developer shall landscape the site and thereafter maintain the same in general conformity with the landscape plans approved by the Municipality (drawing LG1 last revised November 6, 2019), as prepared by MTE Engineering, all to the satisfaction of the Municipality.
Landscaping Plan a) The Developer shall be responsible for and may develop and maintain the Property in accordance with the Landscaping Plan in Schedule “F” attached and forming part of this Agreement, except where otherwise permitted pursuant to clause 3.2.4 (b).
b) The Developer agrees to, in consultation with the Town’s Urban Forestry Technician, make modifications to the Landscaping Plan to increase species diversity and eliminate invasive plant species.
Landscaping Plan. A landscaping plan must be submitted with the Corporate Authorities prior to development of the tract. This plan must reflect conformance with standards for screening of industrial storage and required landscape buffers, as required by the Urbana Zoning Ordinance.
Landscaping Plan. The landscaping plan for the areas of any lot or block of future lots within fifty (50) feet of the boundary of the lot or block line adjacent to golf fairway property shall be in general conformity with the overall landscaping pattern for the golf course fairway area established by the golf course architect, and all individual lot or block landscaping plans must be approved by the Company, its agents, successors and assigns before implementation.
Landscaping Plan. A detailed landscaping plan shall be drawn at a scale that clearly identifies the following:
(1) Location of all plant materials, a legend with botanical and common names, and size of plant materials;
(2) Property lines and street names;
(3) Existing and proposed buildings, walls, fences, utilities, paved areas and other site improvements;
(4) Existing trees and plant materials to be removed and retained;
(5) Designation of landscape zones; and
(6) Details and specification for tree staking (trees less than a two-inch caliper must be double staked until the trees mature to two-inch caliper), soil preparation, and other planting work.
Landscaping Plan. At Tenant’s request, Landlord has not completed the landscaping pursuant to the landscaping plan approved by Chadds Ford Township. Tenant wishes to implement its own landscaping plan, which plan must be approved by the Township. Landlord has provided Tenant with an allowance equal to $123,000.00 for the completion of the landscaping plan, a building monument sign, and the potential irrigation system for the front lawn area of the building. Tenant has agreed to assume the liability for the installation of said landscaping and building monument sign, however, it may use the allowance for the irrigation system for whatever purpose it may choose. Prior to submitting its revised landscaping plan to the Township for approval, Tenant shall submit it to Landlord for its review and approval, which approval shall not be unreasonably withheld. Landlord’s approval shall not indicate the proposed plan complies with all Township ordinances and other applicable laws. If said plan requires variance(s) or other special action by the Township, it shall be Tenant’s obligation(s), at its expense, to obtain the same. Landlord agrees to cooperate with Tenant in the submission of the landscaping plan to the Township for approval, including any requests for variance(s). If Landlord is required to retain legal counsel for the purpose of appearing before the Board of Supervisors, the Zoning Hearing Board or any court on appeal, Tenant agrees to reimburse Landlord all reasonable, documented legal fees, engineering costs or other expenses incurred by Landlord as a part of its participation with Tenant in obtaining approval of the amended landscaping plan. Tenant further agrees to complete all of the landscaping as set forth in the amended landscaping plan as approved by the Township in a timely manner at its cost and expense, as permitted by weather conditions. In the event that Chadds Ford Township demands that the already-approved landscaping be installed by the Landlord in the spring, or at any other time prior to approval of the revised landscaping plan, Landlord may proceed to install same, at Tenant’s expense, and Tenant shall cooperate with Landlord’s efforts to do so. Thereafter, Tenant may obtain approval and install its revised landscaping plan.
Landscaping Plan. Operator shall prepare a plan that shall be coordinated with the City and the surface owner and, depending on access to water, may be staged to accommodate surface development. Landscaping plans should use drought tolerant species that are native and less desirable to wildlife and suitable for the climate and soil conditions of the area. An irrigation plan may be required where buffering is accomplished with vegetation.
