Construction Commencement The Connecting Transmission Owner shall commence construction of the Connecting Transmission Owner’s Attachment Facilities and System Upgrade Facilities and System Deliverability Upgrades for which it is responsible as soon as practicable after the following additional conditions are satisfied:
Service Commencement Date The date the Transmission Provider begins to provide service pursuant to the terms of an executed Service Agreement, or the date the Transmission Provider begins to provide service in accordance with Section 15.3 or Section 29.1 under the Tariff.
Date of Commencement This Agreement has commenced and shall be deemed to have commenced on and with effect from the date mentioned at the beginning of this Agreement.
DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION § 3.1 The date of commencement of the Work shall be: (Check one of the following boxes.) [ « » ] The date of this Agreement. Commencement of Service The Performance Start Date occurred on September 1, 2020. The Expansion Delivery Start Date shall be no later than February 1, 2025, or other date as agreed to in writing by the Parties. Failure of the Agency and the District to meet this deadline shall constitute an Event of Default upon which the Company may terminate this Agreement in accordance with Section 20. The Company shall not incur anycosts or be responsible for any payments under this Agreement prior to the Performance Start Date. The Company shall not incur any costs or be responsible for any payments under this Agreement relating to the Expansion prior to the Expansion Delivery Start Date.
