LESSOR'S RESPONSIBILITY. Lessor shall furnish, at Lessor’s expense, heat, water, lights, and air conditioning necessary for Lessee’s use during the term of this Agreement. Lessor will also provide the items listed on the attached supplies list. Lessor shall not be responsible for or liable to Lessee for any loss resulting from any lack of heat, water, lights, or air conditioning due to an act of God or the failure of equipment to operate or function properly through no fault or act of Lessor.
LESSOR'S RESPONSIBILITY. Lessor is responsible only for any loss, expense, injury or damage caused by Lessor or Lessor's agent. Lessor is not responsible for any loss, expense, injury or damage to any person or property caused by items including but not limited to theft, fire, ice, snow, rain, water, or leaks. Lessor is not responsible for other persons parking vehicles in Lessee’s Parking Space.
LESSOR'S RESPONSIBILITY. Lessor shall keep the structural supports, exterior surfaces, and structural elements of the exterior walls and roof of the buildings that are a part of the Demised Premises in good order and repair at Lessor's expense. Lessor shall not, however, be under any obligation to maintain windows, doors, or glass wherever located. Lessor shall also operate and maintain the common areas and facilities as hereafter provided. Lessor shall have no responsibility to make any repairs hereunder until a reasonable time after receipt of written notice of the need for such repairs.
LESSOR'S RESPONSIBILITY. Lessee shall, at all times during the term hereof and upon surrender or termination, keep and maintain in good and substantial order and repair and make all necessary repairs, renewals, replacements, and decorations upon or in connection with all other parts of the Demised Premises, not explicitly the responsibility of Lessor, at Lessee's sole cost and expense. These parts of the Demised Premises include, but are not limited to, all doors, windows, window wall assembly and door frames, glass, walls and wall coverings, floors and floor coverings, electrical installations, plumbing installations and fixtures, heating, ventilating, and air-conditioning equipment and systems, pipes, wiring, gas, steam, and electrical equipment and fixtures, dock bumpers, seals, and dock equipment and facilities, and all other installations, equipment, fixtures, and appurtenances.
LESSOR'S RESPONSIBILITY. Lessor, at Lessor's sole cost and expense, shall maintain and repair, the structural integrity of the roof, walls, floors and the foundations of the Premises. This is subject to and contingent upon Lessee, Lessee's agents or representative not abusing or misusing the Building and the Premises.
LESSOR'S RESPONSIBILITY. Lessor shall furnish, at Lessor’s expense, heat, water, lights and air conditioning, where available, necessary for Xxxxxx’s use during the term of this contract deemed necessary by the Director and all necessary janitorial services deemed necessary by the Director, and cause the premises herein above described to be kept clean and generally cared for during the term of this contract, except that Lessor shall not be responsible for or liable to Lessee for any loss resulting from lack of heat, water, lights or air conditioning due to an act of God or the failure of equipment to operate or function properly through no fault or act of Lessor.
LESSOR'S RESPONSIBILITY. For Prior Contamination By Hazardous Substances
(a) Except as otherwise expressly disclosed in Exhibit "D" or in the Phase One Environmental Report on the Leased Property being provided to Lessee by Nissan - BMW of Bakersfield, Inc. (the "Phase One Report"), Lessor represents and warrants to Lessee that: (i) no business activities of Nissan - BMW of Bakersfield, Inc. prior to the Initial Lease Date shall have produced any Hazardous Materials, the presence or use of which upon the Leased Property would violate any federal, state, local or other governmental law, regulation or order or would require reporting to any governmental authority, and (ii) there are no in-ground hoists, underground gas tanks, underground fuel tanks, or underground waste oil tanks located on the Leased Property, and (iii) the Leased Property is otherwise free and clear of any Hazardous Materials.
(b) Lessor agrees to indemnify, defend, protect and hold harmless Lessee and each of Lessee's members, partners, stockholders (if any), employees, agents, successors and assigns (collectively referred to for the remainder of this Paragraph 9 as "Lessee"), from and against any and all criminal and civil claims and causes of action (including but not limited to claims resulting from, or causes of action incurred in connection with, the death of or injury to any person, or damage to any property), liabilities (including but not limited to liabilities arising by reason of actions taken by any governmental agency), penalties, forfeitures, prosecutions, losses and expenses (including reasonable attorney fees) which directly or indirectly arise from or are caused by either: (i) the presence, prior to the Initial Lease Date, in, on, under or about the Leased Property or any improvements located thereon, of any Hazardous Materials, or (ii) any breach of the warranties made by Lessor in subparagraph 9(a). Lessor's obligations under this subparagraph 9(b) shall include, but not be limited to, the obligation to bear the expense of any and all costs, whether foreseeable or unforeseeable, of any necessary (as required by the Laws) repair, cleanup, detoxification or decontamination of all or any portion of the Leased Property (or any improvements located thereon), and the preparation and implementation of any closure, remedial action or other required plan or plans in connection therewith. LESSOR'S RESPONSIBILITY. Except for the expenses specifically to be paid by Lessor pursuant to Section 6.2 and 6.3 below, all expenses and charges required to be paid to maintain the Leased Premises shall be the responsibility of Lessee.
LESSOR'S RESPONSIBILITY. 13.1.1 The Lessor shall be responsible for all Major Maintenance.
13.1.2 The Lessee shall notify the Lessor promptly of the need to carry out any Major Maintenance to the Leased Asset and until such time the Lessor shall not be under any responsibility or obligation to perform Major Maintenance.
LESSOR'S RESPONSIBILITY. LESSOR agrees to observe all laws and regulations dealing with environmental matters and agrees to hold LESSEE harmless from any loss, cost or expense incurred by LESSEE as a result of LESSOR's failure to do so.
