Phase One. Emergent Issues Discussion 1. Program Director 2. Post-Grad Assistant Xxxx 3. Xxxx (or designate) In this Phase, the intention of the parties is to identify issues and seek the assistance of the College of Medicine (COM) in clarifying/correcting/resolving the issue(s). It is understood that the COM will engage the relevant Regional Health Authority (RHA) in an effort to achieve a timely result and that such result will be reported back to the Union as soon as practicable. Matters referred to Phase One are not subject to the grievance procedure provided in this Agreement.

Phase One. The Consulting Landscape Architect shall: 1. Refine the previously-prepared site grading plan, determine earthwork quantities and modify the grading plan to achieve a balanced site. Consulting Landscape Architect shall utilize site topographic information provided by the City. 2. Prepare construction documents for the final rough site grading plan, prepare earthwork specifications, and assist staff with earthwork contractor for review and pricing. Assist with obtaining any required permits or plan approval. 3. Assist staff with coordination of the earthwork operations with 4-5 visits to the site. 4. Work for Phase One, tasks 1 and 2, shall be completed by July 1, 2006. Task 3 shall be completed concurrent with actual rough site grading operations. Cost: $ 13,000.00

Phase One starts in June 2012 and ends in December 2012. Case studies I-IV will be undertaken during this phase.

Phase One. Until the end of the Gene Presentation Period, Schering will pay Collateral the amounts provided in this Section for the activities it under takes pursuant to the critical studies plan and budget for each of three (3) six (6) month periods (collectively, the "Phase One Plan and Budgets"). The first Phase One Plan and Budget is attached as Exhibit 5. 1. At any time during the Gene Presentation Period, the Parties may meet to prepare the second and third Phase One Plan and Budget to be attached as successive Exhibits pursuant to this Section. The second and third Phase One Plan and Budget shall be negotiated in good faith between the parties; provided, that the second Phase One Budget shall be a minimum of $1,000,000. Schering, in its sole discretion, subject to good faith negotiation, will decide how much cash, if any, it will provide to Collateral for the third Phase One Plan and Budget. Within three (3) days of the Effective Date, Schering will wire transfer $625,000 Dollars to Collateral's account number 0600795375 at Silicon Valley Bank (ABA No. 000000000) for the account of Collateral.

Phase One. Upon execution of this document, PMW shall receive $25,000 (twenty five thousand dollars). For this the Client shall receive a “first draft” of the script “Over the Hedge.”
