LIE DETECTOR TEST. The Employer shall not require an employee to take a polygraph or any other form of lie detector test.

LIE DETECTOR TEST. No employee or applicant for employment shall be required to take a lie detector test as a condition of employment or continued employment. The use of lie detector tests shall be voluntary.

The employer shall be allowed to require an employee to take a polygraph or any other form of lie detector test or exam, provided that the employee be given the opportunity to have another individual of his/her choosing review the questions to be asked. The employer shall have sufficient cause to require the employee to take a polygraph or other form of lie detector test or exam. The test shall cover the incident under investigation. A copy of the questions shall be furnished the employee prior to examination by the polygraph operator. Failure to take the polygraph examination will result in a disciplinary action.
