Other than the Limited Warranty: THE WILIOT IoT PIXELS, HARDWARE, WILIOT PLATFORM, SERVICES, AS WELL AS ANY OTHER GOODS AND SERVICES PROVIDED OR MADE AVAILABLE BY OR ON BEHALF OF WILIOT HEREUNDER (COLLECTIVELY, THE "WILIOT MATERIALS") ARE PROVIDED AND MADE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL DEFECTS, AND ALL EXPRESS, IMPLIED AND STATUTORY CONDITIONS AND WARRANTIES (INCLUDING WITHOUT LIMITATION ANY IMPLIED CONDITIONS OR WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET POSSESSION, NON- INFRINGEMENT, OR QUALITY OF SERVICE, OR THAT OTHERWISE ARISE FROM A COURSE OF PERFORMANCE OR USAGE OF TRADE) ARE HEREBY DISCLAIMED BY WILIOT AND ITS LICENSORS. WILIOT DOES NOT MAKE ANY REPRESENTATION, WARRANTY, GUARANTEE OR CONDITION: (A) REGARDING THE EFFECTIVENESS, USEFULNESS, RELIABILITY, TIMELINESS, COMPLETENESS, OR QUALITY OF WILIOT MATERIALS; (B) THAT CUSTOMER'S USE OF WILIOT MATERIALS WILL BE UNINTERRUPTED, SECURE OR ERROR- FREE; (C) REGARDING THE OPERATION OF ANY CELLULAR NETWORKS, THE PASSING OR TRANSMISSION OF DATA VIA ANY NETWORKS OR THE CLOUD, OR ANY OTHER CELLULAR OR DATA CONNECTIVITY PROBLEMS; OR (D) REGARDING THE SATISFACTION OF, OR COMPLIANCE WITH, ANY LAWS, OR OTHER GOVERNMENT OR INDUSTRY RULES OR STANDARDS. WILIOT WILL NOT BE LIABLE OR OBLIGATED IN RESPECT OF DELAYS, INTERRUPTIONS, SERVICE FAILURES OR OTHER PROBLEMS INHERENT IN USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS OR FOR ISSUES RELATED TO HOSTING PROVIDERS OR PUBLIC NETWORKS.
Limited Warranty Disclaimer of Warranties. Licensor warrants that it has the legal right and title to grant the license rights under this Agreement to Licensee (“License Rights”). While the Licensor has tried to ensure that the Software Product is accurate and free from defect, it is provided “as is” without warranty of any other kind, except for a warranty breach for License Rights. Licensee and its affiliates assume the entire risk as to the results and performance of the Software Product. Limited Warranty Disclaimer of Warranties. 7.1 Zerto warrants that (i) it has the right to grant the licenses to the Software; (ii) the Software will substantially conform in material respects to the Zerto Virtual Manager Administration Guide made available to You during the installation process; and (iii) It is the owner of, or has the right to license, copyright, in the Software and the Zerto Virtual Manager Administration Guide. This limited warranty is not transferable and extends only for thirty (30) days from the delivery date of the Software. In no event shall Seller be responsible for goods manufactured by other parties; such goods shall carry only the warranty of the manufacturer.
Limited Warranty Disclaimer of Warranties a) The workmanship, material, and performance of the Products are warranted to be commensurate with the levels established in the applicable documents or specifications referenced on the Purchase Order and issued by public or private bodies with duly constituted authority and in the absence of specific reference to such documents or specifications to be free of material defects in workmanship and materials. If reported defects in material or workmanship are substantiated by Seller, such parts and materials as are affected will be replaced or repaired by Seller at its discretion. This warranty is limited to defects which arise within three (3) years of the date of delivery, except claims for non-conforming textile materials must be presented to Seller, in writing, within one (1) year of the date of delivery.

(a) Upon the delivery of the Equipment to Lessee, Lessor shall assign the limited warranty on the Equipment described on Exhibit A attached hereto from Supplier to Lessee. Such assignment by Lessor shall be without recourse. SUCH WARRANTY SHALL NOT RELEASE LESSEE FROM ITS OBLIGATION TO PERFORM ALL OBLIGATIONS HEREUNDER AND TO KEEP, MAINTAIN AND SURRENDER THE EQUIPMENT IN THE CONDITION REQUIRED BY SECTIONS 12 AND 13 HEREOF.
Limited Warranty Disclaimer of Warranties. 3.1 Licensor agrees to pass through to Licensee all warranties provided to Licensor by third parties relating to any third party software embedded in the Software or otherwise licensed or provided to Licensee by Licensor hereunder. Notwithstanding the foregoing, in the event Software contains any software code developed by third parties and licensed pursuant to either the GNU General Public License or the GNU Lesser General Public License such code is supplied without warranty of any kind.
