Manufacturer Warranty. To the extent that manufacturer warranties cover replacement and repair of covered equipment during the Term, Provider, on behalf of the Company, shall use commercially reasonable efforts to submit, process and pursue, at the Company’s sole cost and expense, warranty coverage; provided, that the Company shall have no obligation to pay costs of Provider in connection with pursuit of warranty coverage, the costs of which are covered under the warranty provided in Section 3.4 of the EPC Agreement or are required to be indemnified by Vivint Solar Developer, LLC under the EPC Agreement, solely if Provider is then an Affiliate of Vivint Solar Developer, LLC. The Company will provide such full and complete cooperation as Provider may reasonably require in connection with the submission, processing and pursuit of warranty coverage.
Manufacturer Warranty. To the extent that the Sale Equipment is the subject of a warranty provided by the manufacturer of the Sale Equipment (Manufacturer Warranty),TEN will do all things reasonably necessary to ensure that the Customer obtains the benefit of the Manufacturer Warranty during the period of time for which the Manufacturer Warranty applies under the terms of the Manufacturer Warranty.
Manufacturer Warranty. The Contractor shall provide manufacturer warranty documentation for equipment/goods/materials provided under this Contract for a period of one (1) year from the date of acceptance by the CGA of the equipment/goods/materials. During this warranty period, ordinary wear and tear, or deficiencies in any or all of the component materials of the product shall be corrected or replaced immediately by the Contractor without expense to the CGA. Replacement equipment/goods/materials provided pursuant to this clause shall be of equal to or better quality, as determined by the CGA. Alternate replacement equipment/goods/materials may also be proposed by the Contractor, but subject to final approval by the CGA.
Manufacturer Warranty. The Contractor confirms that it is duly authorized by the manufacturer of the Goods to distribute the Goods and that OPG will be entitled to the full benefit of all warranties, customer service, maintenance and repair programs offered by the manufacturer. Unless otherwise stated in this Contract, all Goods supplied will be the most current model or version commercially available at the time of supply, will be new and comprised entirely of genuine unused components in good operating condition and will be fully eligible for maintenance service without any requirement for further qualification or inspection.
Manufacturer Warranty. All major equipment must meet the following minimum manufacturer warranties:
i. Photovoltaic Module: Minimum of one (1) year product warranty from date of sale to first consumer purchaser for product workmanship and materials, plus a minimum performance warranty of twenty (20) years within which time the module will produce, under standard test conditions, a minimum of 80% of the product’s minimum rated power at time of sale.
ii. Inverters: Minimum of ten (10) years product warranty from date of sale to first consumer purchaser for product workmanship and materials.
iii. Batteries: Minimum of ten (10) years product warranty from date of sale to first consumer purchaser for product workmanship and materials.
iv. Revenue grade production meters: Minimum of two (2) years following the effective commercial operation date that the meter system will be free from all defects in design, materials and workmanship.
Manufacturer Warranty. 16.1 Nothing in this Agreement excludes or alters your rights under any warranty provided by a manufacturer of Hardware, SaaS Services or Software.
16.2 Nothing in this Agreement is intended to prevent you from directly contacting the manufacturer in relation to the warranty offered by the manufacturer or in relation to any other matter.
Manufacturer Warranty. In addition, Contractor will assign and pass through to Owner warranties from manufacturers of products installed in the Project. Such manufacturers’ warranties are attached hereto as Exhibit C.
Manufacturer Warranty. The Contractor agrees to honor all manufacturers' warranties and guarantees on all products offered as part of the Master Agreement. The Contractor understands that if warranty extends beyond the term of the Contract, the Contractor must agree to provide warranty services throughout the llif e t im e of the xxxxxxxx.Xx the event that a situation arises, Contractor shall pass through all available warranty benefits from the applicable manufacturer to the Lead State and any Participating/Purchasing Entities to the extent permitted by contract or applicable law. These parts must be warranted to be free of defective parts and workmanship, provided they are properly installed on the vehicle for which they were intended, for the time and mileage shown in the product literature or catalog. Statement of warranty is to be provided by Contractor with items delivered under this Master Agreement. For all items ordered, warranty begins on the date of delivery.

Such warranty, containing no exclusions or limitations, shall be in a form acceptable to, and for the benefit of, the User.
Manufacturer Warranty. Seller agrees that all warranties and representations made by the manufacturer are intended to be and shall pass through to Buyer. Seller shall take all necessary steps to ensure that such warranties and representations flow through, to and for the benefit of Buyer, and that the effective date of such warranties starts the first day of use. Seller further represents that it has not and will not enter into any agreements with the manufacturer providing that the sale or use of Goods as contemplated by the Purchase Order shall in any way limit, negate or nullify such manufacturer’s warranty.
