Maintenance of Data. (a) To the extent that any data, materials and documents referred to in this Article 27 (Intellectual Property) are generated by or maintained on a computer or similar system, the Development Entity shall use Reasonable Efforts to procure for the benefit of the Department, at no charge or at the lowest reasonable fee, the grant of a license or sublicense for any relevant software to enable the Department or its nominee to access and otherwise use (subject to the payment by the Department of the relevant fee, if any) such data for the purposes set out in Section 27.1 (Intellectual Property). As an alternative, the Development Entity may provide such data, materials or documents in a format which may be read by software generally available in the market at the relevant time or in hard copy format.
(b) The Development Entity shall ensure the back-up and storage in safe custody of the data, materials and documents referred to in Section 27.2(a) in accordance with Good Industry Practice. Without prejudice to this obligation, the Development Entity shall submit to the Department’s Authorized Representative for approval its proposals for the back-up and storage in safe custody of such data, materials and documents and the Department shall be entitled to object if the same is not in accordance with Good Industry Practice. The Development Entity shall comply, and shall use Reasonable Efforts to cause all the Development Entity-Related Entities to comply, with all procedures to which the Department’s Authorized Representative has given its approval. The Development Entity may vary its procedures for such back-up and storage subject to submitting its proposals for change to the Department’s Authorized Representative, who shall be entitled to object on the basis set out above.
Maintenance of Data. CONTRACTOR shall maintain accurate and complete books, 14 records, data and documents on generally accepted accounting principles in accordance 15 with Uniform System of Accounts and Records adopted by the State Controller pursuant 16 to Section 99243 of the Public Utilities Code, and as required by ICTC or the California 17 Department of Transportation (“Cal Trans”). Such records shall be kept in such detail 18 and form so as to meet applicable local, State and Federal requirements.
Maintenance of Data. DELTAGEN shall maintain all written Data for a period of not less than two (2) years. At the expiration of such two (2) year period, ROCHE BIOSCIENCE, at ROCHE BIOSCIENCE's cost and expense, shall promptly arrange with DELTAGEN for delivery of such Data to ROCHE BIOSCIENCE or DELTAGEN may dispose of such written Data sixty (60) days after providing written notice of the same to ROCHE BIOSCIENCE. * * * Confidential material redacted and separately filed with the Commission.

To the extent that any of the data, materials and documents referred to in clause 46 are generated by or maintained on a computer or similar system, the Service Provider shall use all reasonable endeavours to procure for the benefit of E-ACT, at no charge or at the lowest reasonable fee, the grant of a licence or sub-licence for any relevant software to enable E-ACT or its nominee to access and otherwise use (subject to the payment by E-ACT of the relevant fee, if any) such data. As an alternative, the Service Provider may provide such data, materials or documents in a format which may be read by software generally available in the market at the relevant time or in hard copy format.
46.2. The Service Provider shall ensure the back-up and storage in safe custody of the data, materials and documents referred to in clause
46.1 in accordance with Good Industry Practice. Without prejudice to this obligation, the Service Provider shall submit to E-ACT's Representative for approval its proposals for the back-up and storage in safe custody of such data, materials and documents and E-ACT shall be entitled to object if the same is not in accordance with Good Industry Practice. The Service Provider shall comply, and shall cause all Service Provider Related Parties to comply, with all procedures to which E-ACT's Representative has given its approval. The Service Provider may vary its procedures for such back-up and storage subject to submitting its proposals for change to E-ACT's Representative, who shall be entitled to object on the basis set out above.
Maintenance of Data. Effective immediately, the College agrees to maintain documents and other data relating to specific complaints or other reports of sexual harassment of students, regardless of sanction, including the following:
Maintenance of Data. Optional Data Groups and Data Items only need to be populated where the data is readily available. The data sent will be processed according to the relevant rules, or may be ignored. • The design does not prescribe what Data Items might be maintained by an incremental update rather than being sent on each RGMA Data Flow, as this is considered a matter for commercial agreement. The file layouts allow all information a Market Participant wishes to send to be sent, and the file layouts allow MAMs (for example) to return updates. Some organisations may not require this extra functionality e.g. Meter Point addresses, information on consumers (names, addresses, care details and contact mechanisms) may all be maintained by incremental updates. • The flows do not prescribe who originates data. For example, some Suppliers may wish the MAM to organise the appointments, contacts and site addresses as part of their service. If this is the case then the related consumer name, address, care details and contact mechanisms would not be required. • Validation of data should be appropriate to ensure minimal delay in the transfer of Asset information across the industry. For example, if a Meter is removed, the transfer of this information needs to have priority over updating the information on the removed Meter. Similarly, unless Meter Point address updates indicate that the Meter Worker has visited the wrong property, the transfer of the Asset data should not be delayed until the Meter Point address has been corrected. • Minimisation of data integrity issues: In the file formats, if a value of a Data Item is not always known then the Data Item is Optional. The exception to this is the Meter Point address (ORJOB and ONAGE appointment), where the postcode, if not known, is set to a default value as allocated by the GT responsible for the relevant Meter Point address.

As an alternative, DBFM Co may provide such data, materials or documents in a format which may be read by software generally available in the market at the relevant time or in hard copy format. DBFM Co shall ensure the back up and storage in safe custody of the data, materials and documents referred to in Clause 55.3 in accordance with Good Industry Practice. Without prejudice to this obligation, DBFM Co shall submit to the Authority's Representative for approval its proposals for the back up and storage in safe custody of such data, materials and documents and the Authority shall be entitled to object if the same is not in accordance with Good Industry Practice. DBFM Co shall comply, and shall cause all DBFM Co Parties to comply, with all procedures to which the Authority's Representative has given its approval. DBFM Co may vary its procedures for such back-up and storage subject to submitting its proposals for change to the Authority's Representative, who shall be entitled to object on the basis set out above.
Maintenance of Data. A. The School will maintain documents relating to complaints of racial harassment of students at the School, including those complaints that are filed through the District’s UCP and reported informally, or confidentially pursuant to the District’s Board Policies BP 5145.3, 5145.9, 1312 and/or observed or witnessed directly by a staff member at the School. The documentation will include the following:
1. A copy of all reports, of incidents involving allegations of racial harassment;
2. A narrative of all actions taken in response to the reports by District personnel, including any written documentation;
3. A copy of any and all corrective or disciplinary actions issued to students or employees for violations of the harassment policies and procedures;
4. Documentation demonstrating any interim and/or remedial efforts offered and provided to the complainant, the alleged harasser and/or witnesses of the incident(s), such as counseling or other appropriate services; and,
5. A narrative of all actions taken to prevent recurrence of any harassing incident(s), including any written documentation.
6. The information contained in VI.A will be sent to the District at the end of each school year.
B. The District will provide OCR with documentation of any reports or complaints of racial harassment toward students at the School during the 2017-2018 school year. The documentation will include the data described in VI.A.1-5. If OCR identifies compliance concerns with respect to the aforementioned documentation, OCR will provide technical assistance to the District regarding those concerns.
