Mediation Period. Mediation pursuant to this Section 8.5 shall be conducted over a period of forty-five (45) calendar days following the appointment of the mediator. If the dispute cannot be resolved within forty-five (45) calendar days following the appointment of the mediator or by the end of any mutually agreed continuation thereof, either the Department , the Service Provider or the mediator may give written notice declaring the mediation process terminated. If the mediation is terminated in accordance with this Section 8.5.4, either Party may pursue any rights it has under this Contract, including instituting legal action.
