MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the Member's continued fulfillment of the terms and conditions of this agreement, the Cooperative covenants that the Member may at all times while this agreement remains in effect, have and enjoy for his sole use and benefit the dwelling unit herein above described, after obtaining occupancy, and may enjoy in common with all other members of the Cooperative the use of all community property and facilities of the cooperative.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the Member's continued compliance with the terms and conditions of this Occupancy Agreement, the Cooperative agrees that the Member may at all times, while this Occupancy Agreement remains in effect, have and enjoy for their sole use and benefit, the Space described above, and may enjoy in common with all other Members of the Cooperative the use of all community property and facilities of the Park. Notwithstanding the foregoing, the use and benefit of the Space must at all times be in compliance with the Governing Documents and Operating Rules.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the occupant's continued fulfillment of the terms and conditions of this agreement, the Co-op covenants that the occupant may at all times while this agreement remains in effect, have and enjoy for occupant's sole use and benefit the dwelling unit hereinabove described, and may enjoy in common with all other members and occupants of the Co-op all community property and facilities of the Co-op.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In consideration of the Member’s full and continuing compliance with the terms and conditions of this Agreement, the Corporation covenants that, so long as this Agreement remains in effect, Member may have and enjoy the use, benefit and peaceable possession of the dwelling unit referenced herein, and may further enjoy in common with all other Members of the Corporation, the use of all common property and facilities of the Corporation. Provided further, however, that the Member specifically understands and agrees that the commitment of any of the following acts by Member, or by any person occupying or visiting Member’s dwelling unit, shall constitute violation of the other Members’ rights to peaceable possession and constitute just cause for the termination of this occupancy agreement.
1. ILLEGAL ACTIVITY- Neither Member, nor any person in Member’s household, nor any guest present on or near the Corporation premises with Member’s permission, express or implied, shall engage in any form of criminal activity, including without limitation, drug-related criminal activity. “Drug-related Criminal Activity” as utilized herein shall mean the illegal manufacture, sale, distribution, use or possession with intent to manufacture, sell, distribute, or use of a controlled substance (as defined in Section 102 of the Controlled Substance Act (21 U.S.C.002).
2. CRIMINAL ACTIVITY - Neither Member, nor any person in Member’s household, nor any guest present on or near the Corporation premises with Member’s permission, express or implied, shall engage in any criminal act or any act intended or calculated to facilitate criminal activity.
3. ACTS OF VIOLENCE - Neither Member, nor any person in Member’s household, nor any guest present on or near the Corporation premises with Member’s permission, express or implied, shall engage in or threaten any act of violence, including but not limited to, the discharging of firearms on or near the Corporation premises.
4. CAUSE FOR TERMINATION - A single violation of any of the above provisions shall be a material violation and a condition of default under this Occupancy Agreement, and Member understands and agrees that any violation shall constitute good cause for termination of the Occupancy Agreement. The Board of Director’s determination of the existence of a violation justifying termination shall be final and conclusive. This provision will be vigorously enforced.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the Member’s continued fulfillment of the terms and conditions of this agreement, the Corporation covenants that the Member may at all times while this agreement remains in effect, have and enjoy for his/her use and benefit the dwelling unit, after obtaining occupancy, and may also enjoy in common with all other Members of the Corporation the use of all community property and facilities of the Corporation excluding Eastwick Square Center.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. 1. In return for the Members continued fulfillment of the terms and conditions of this Agreement, the Corporation agrees that during the term of this Agreement, the Member has the right to enjoy the Unit for his/her sole use and benefit and may enjoy in common with all the members of the Corporation the use of all common areas and facilities in this community.
2. If the Corporation is required to take legal action to remove either the Member or the Member’s animal(s) from the Unit, the Member agrees to pay the Corporation’s reasonable attorney fees incurred.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the Member’s continued fulfillment of the terms and conditions of this Lease, the Cooperative covenants that the Member may at all times which this Lease remains in effect, have and enjoy for his or her sole use and benefit the dwelling unit hereinafter described, after obtaining occupancy, and may enjoy in common with all other members of the Cooperative the use of all community property and facilities of the project.
MEMBER'S RIGHT TO PEACEABLE POSSESSION. In return for the Stockholder’s continued fulfillment of the terms and conditions of the Occupancy Agreement, the Mutual agrees that the Stockholder may, while this Agreement remains in effect, have and enjoy the Apartment for the Stockholder’s sole use and benefit, after obtaining occupancy. The Stockholder may use, in common with the other Mutual members, all community property and facilities of the Project, as well as the community facilities held in trust by the Foundation, so long as the Stockholder continues to own the Stock, occupies the Apartment, and abides by the terms of the Occupancy Agreement.
