Minimum Quantity. Dealer will not be required to stock a minimum quantity of the Products for the first two years of this Agreement. ASTI shall ship the Products directly to Dealer's customers or to Dealer FOB ASTI's warehouse
Minimum Quantity. “Minimum Quantity” shall have the meaning set forth in Section 2.6.
Minimum Quantity. If you place an order for less than the minimum order quantity specified in our applicable price list, then we may either not accept the order, or deem your order to be an order for the minimum quantity, at our discretion.
Minimum Quantity. 7.1 During [the Term] OR [[period]]:
(a) the Manufacturer shall supply the Minimum Quantity of Products to the Customer; and
(b) the Customer shall purchase the Minimum Quantity of Products from the Manufacturer, under 1 or more Orders to be agreed by the parties acting reasonably.

8.2 If the Distributor does not comply with its obligation in this Article 8, Clause 8.1 above, the Vendor shall be entitled to convert the exclusive rights for the US Products as mentioned under Article 2 ABOVE TO A NONexclusive right by registered letter within ninety (90) days after each forecasting period on giving thirty (30) days notice. Failure to comply with the obligations in Article 8, Clause 8.1 shall not be a material breach of this Agreement and the Vendor sole and exclusive remedy for such failure is set forth in this Clause 8.2.
8.3 The Distributor shall purchase Haemofix Blood Lancet within the term of this Agreement an accordance to the schedule in Appendix 2. At no time during the first two twelve (12) month time periods, as stipulated in Appendix 2, can the order quantities of the Products fall below the minimum quantities set forth in the APPENDIX 2. AT NO TIME during the twelve months periods, three (3) through four (4) inclusive, as stipulated an Appendix 2, can the order QUANTITIES OF the Products fall more than twenty (20) per cent below the minimum quantities set forth in Appendix 2.

In D.00-00-000, the Commission determined that in order to count energy deliveries from short- term contracts toward RPS goals, RPS-obligated load-serving entities must contract for deliveries equal to at least 0.25 percent of total retail sales in 2010 if the contract is signed during the first compliance period from 2011-2013. The proposed PSA is a long-term 10-year contract that does not trigger the minimum quantity requirement set forth in D.00-00-000. 7 See D.00-00-000 at 56 (explaining that an IOU’s upfront showing for approval of procurement contracts that would fit within Portfolio Content Category Three must be sufficient for the Commission to determine that the electricity was generated by an RPS-eligible facility). Minimum Quantity. 6.1 SUMITOMO agrees to purchase from TERAYON the minimum annual quantities of PRODUCTS set forth below (each year being measured from the date of TERAYON'S first PRODUCTS shipment to SUMITOMO's end users, except shipments to SUMITOMO for its field trial in the TERRITORY) without any penalty.
