Contracting Requirements. Each contract for invention development services by which an invention developer undertakes invention development services for a customer is subject to this act. The contract must be in writing and the invention developer shall give a copy of the contract to the customer at the time the customer signs the contract.
Contracting Requirements. The DNCC shall prepare the terms, plans and specifications constituting the statement or scope of work for or in respect of any contract, and shall prepare the drafts of all contracts, for goods, services, equipment or facilities to be procured by the Host Committee to meet its obligations hereunder. The DNCC and the Host Committee shall jointly negotiate all such contracts. All contracts between the Host Committee and any Contractor shall be in writing and no such contract shall be executed by the Host Committee unless that contract shall have first been expressly approved in writing by the DNCC. The Host Committee agrees to respond within seven (7) calendar days from the day the DNCC submits such contract for approval with an executed contract or specific objections in writing. The DNCC will discuss with the Host Committee any specific written objections within seven (7) calendar days from the day the DNCC receives specific objections in writing.
Contracting Requirements. All contracts, subcontracts, and agreements between Awardee and third parties must contain all applicable provisions of this Agreement, and copies shall be provided to NDDOT within 30 days of execution of said contracts, subcontracts, and agreements. Except for the furnishing and transportation of materials, no portion of a contract let as a result of this project shall be sublet, assigned, or otherwise disposed of except with XXXXX’s written authorization. Where a subcontract has been authorized, the subcontractor shall be responsible to complete that portion of the contract with its own organization. On contracts involving federal aid, the agreement between the Awardee and subcontractor shall be in writing, and Form FHWA-1273 and the most recent North Dakota predetermined wage rates shall be physically attached to each such agreement.
Contracting Requirements a. This Agreement is subject to the requirements of the Clean Air Act, as amended, 42 U.S.C. § 1857 et seq., the Federal Water Pollution Control Act, as amended, 33 U.S.C. § 1351 et seq., and the regulations of the Environmental Protection Agency with respect thereto, at 40 CFR Part 15, as amended from time to time. In compliance with said regulations, the Agency shall enforce and cause or require to be inserted in full in all contracts and subcontracts, with respect to any nonexempt transaction thereunder funded with assistance provided under this Agreement, the following requirements: i. A stipulation by the contractor or subcontractor that any facility to be utilized in the performance of any nonexempt contract or subcontract is not listed on the List of Violating Facilities issued by the Environmental Protection Agency (“EPA”) pursuant to 40 CFR § 15.20; ii. Agreement by the contractor to comply with all the requirements of Section 114 of the Clean Air Act, as amended (42 U.S.C. § 1857c- 8), and Section 308 of the Federal Water Pollution Control Act, as amended (33 U.S.C. § 1318), relating to inspection, monitoring, entry, reports, and information, as well as all other requirements specified in said Section 114, Section 308, and all regulations and guidelines issued thereunder; iii. A stipulation that, as a condition for the award of the contract, prompt notice will be given of any notification received from the Director, Office of Federal Activities, EPA, indicating that a facility utilized or to be utilized for the contract is under consideration to be listed on the EPA List of Violating Facilities; and iv. Agreement by the contractor that it will include or cause to be included the criteria and requirements referred to in this section in every non-exempt subcontract, and that it will take all appropriate actions to enforce these requirements. b. In no event shall any amount of the assistance provided under this Agreement be utilized with respect to a facility which has given rise to a conviction under Section 113(c)(l) of the Clean Air Act or Section 309(c) of the Federal Water Pollution Control Act.

Contracting Requirements. In accordance with the provisions of this Grant Agreement, the Grantee may contract with public or private contractors of services for activities necessary for the program implementation and activities of the project. Grantee agrees that in the event of an inconsistency between the Grant Agreement, its Exhibits and Grantee’s agreement for services with a contractor, the Grant Agreement and its Exhibits will prevail. Grantee shall ensure that the contractor complies with all requirements of the Grant Agreement. Grantee assures that for any contract awarded by the Grantee, such insurance and fidelity bonds, as is customary and appropriate, will be obtained. The Subrecipient must not knowingly enter into a contract, memorandum of understanding, or cooperative contract with, make a grant to, or provide a loan or loan guarantee to, any corporation that has any unpaid federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely matter pursuant to an contracts with the authority responsible for collecting the tax liability. No funds made available under this Contract may be used for any contract with any foreign incorporated entity which is treated as an inverted domestic corporation under section 535(b) of the Homeland Security Act of 2002 (6 U.S.C. 395(b)) or any subsidiary of such an entity. A cost allocation plan or indirect cost rate proposal is required for all WIOA contracts and subcontracts. Governmental and non-profit agencies are required to follow the requirements of Office of Management and Budget Federal Register. A complete plan or proposal will be submitted annually to WSW’s Fiscal Office for approval.
