MINORITY AND WOMEN’S BUSINESS ENTERPRISES. (MWBE) RECIPIENT is encouraged to solicit and recruit, to the extent possible, certified minority-owned (MBE) and women-owned (WBE) businesses in purchases and contracts initiated under this Agreement. Contract awards or rejections cannot be made based on MWBE participation; however, the RECIPIENT is encouraged to take the following actions, when possible, in any procurement under this Agreement:

MINORITY AND WOMEN’S BUSINESS ENTERPRISES. The Contractor shall comply with Executive Orders 11625, 12432, and 12138. Consistent with HUD's responsibilities under these Orders, the Contractor must make efforts to encourage the use of minority and women's business enterprises in connection with funded activities.
MINORITY AND WOMEN’S BUSINESS ENTERPRISES. City is committed to ensuring that minority and women’s business enterprises (M/WBE) participate to the maximum extent possible in the performance of City contracts. If M/WBE participation goals have been set for this Agreement, Design Professional agrees to comply with all requirements of City’s M/WBE Program as enacted in City’s Code Sections 3-421 through 3-469 and as hereinafter amended. Design Professional shall make its good faith efforts in carrying out this policy by implementing its contractor utilization plan, which is attached as Attachment F. If Design Professional fails to achieve the M/WBE goals stated in its contractor utilization plan, as amended, the City will sustain damages, the exact extent of which would be difficult or impossible to ascertain or estimate at the time of execution of this contract. Therefore, in order to liquidate those damages, the monetary difference between the amount of the M/WBE goals set forth in this contractor utilization plan, as amended, and the amount actually paid to qualified MBEs and WBEs for performing a commercially useful function will be deducted from the Design Professional’s payments as liquidated damages. In determining the amount actually paid to qualified MBEs and WBEs, no credit will be given for the portion of participation that was not approved by the Director of City’s Human Relations Division, unless the Director determines that the Design Professional acted in good faith. No deduction for liquidated damages will be made when, for reasons beyond the control of the Design Professional, the M/WBE participation stated in the Contractor Utilization Plan, as amended and approved by the Director, is not met.
MINORITY AND WOMEN’S BUSINESS ENTERPRISES. (a) CITY is committed to ensuring that minority and women’s business enterprises (M/WBE) participate to the maximum extent possible in the performance of CITY contracts. XXXXXXXXXX agrees to comply with all requirements of City’s Minority and Women’s Business Enterprise Program as enacted in CITY’S Code CITY’S Code Chapter 3 Sections 3-421 through 3-469 and as hereinafter amended. If CITY requrests CONTRACTOR to perform Services with MBE/WBE goals, CONTRACTOR shall make its good faith efforts to meet the MBE/WBE goals. CONTRACTOR shall meet the goals set forth in its Contractor Utilization Plan. .

The Contractor will take affirmative steps to assure that minority and women-owned businesses are used when possible as sources of supplies, equipment, construction and services. Additionally, the Contractor must document all affirmative steps taken to solicit the participation of minority and women-owned businesses, and will forward this documentation (along with the names of the minority subcontractors and suppliers) to the HOME/CDBG Subrecipient. In accordance with 2 CFR 200.321 the Contractor must take all necessary affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus area firms are used when possible. MINORITY AND WOMEN’S BUSINESS ENTERPRISES. In complying with HUD instructions made pursuant to Executive Order 11625, 12432 and 12138 incorporated herein by reference, to xxxxxx and promote minority and women‟s business enterprises and with 24 CFR Section 85.36(e) to award a fair share of Contracts to small and minority and women‟s businesses, the SubRecipient shall maintain documentation of its efforts to assure small and minority and women‟s businesses are considered and used where possible as provided for under 24 CFR Section 85.36(e) which is incorporated herein by reference.
