Issuance of Building Permits. The following permits will not be issued for a phase until the items addressed by each permit necessary to serve that phase are completed and accepted by the City. A. No building permit shall be issued until the public sanitary sewer and water systems are completed and accepted by the City. B. No building permits shall be issued until surface and storm water drainage systems are completed and accepted by the City. C. No building permits shall be issued until the rough grading plan has been submitted and accepted by the City. D. No building permit for a lot shall be issued until payment of the park Development fee, if applicable. E. No building permit shall be issued until the road base, curbs and gutters on the streets have been installed and preliminarily accepted by the City unless otherwise permitted by the City Engineer. F. No building permits shall be issued until the sanitary sewer system is televised and all repairs to the defects to the same are made, and the City is supplied a digital copy of the sanitary sewer system and all sewer lines are cleaned. G. Final acceptance of the improvements permitted shall not be given until all as- built plans have been submitted and approved by the City. H. No occupancy permits be issued until all private utilities have been installed and accepted by the City. I. No building permits shall be issued until removal of unwanted items, including buildings, have been completed. J. No occupancy permit shall be issued by the City for any lot until the first lift of asphalt has been installed on the street adjoining said lot.

Issuance of Building Permits. No building permit, final inspection or certificate of occupancy will be unreasonably withheld from Developer if all infrastructure required to serve the portion of the Development Agreement Property covered by the building permit is in place or is scheduled to be in place prior to completion of construction and all of the other relevant provisions of the Prior Approvals, Subsequent Approvals and this Agreement have been satisfied. In no event shall building permits be allocated on any annual numerical basis or on any arbitrary allocation basis.

Issuance of Building Permits. A. General Restrictions on the Issuance of Building Permits until certain Public Infrastructure is completed. In areas where Village sewer and water are not available, an approved well system and approved septic system can be used in lieu of municipal sewer and water; however, a passable graded road must abut such lot which will allow proper and ready access for fire, police and other Village services. C. If permits for construction of homes are issued by the Village prior to acceptance of the dedication of all improvements by the Village per Section II(A) above, it is understood that the Village will assume no liability for any damages which may occur to the municipal improvements, and the Developer agrees that any such damages shall be repaired at his sole expense to the complete satisfaction of the Village.
Issuance of Building Permits. Prior to the issuance of any building permits, all of the following Improvements shall be installed and shall have received preliminary approval from the Town, which requires a finding by the Town Engineer that such Improvements are safe to be used during construction: streets; street signage; water; wastewater; drainage facilities; and streetlights, provided that such streetlights may be temporary at the time of issuance of building permits, but must be permanent prior to issuance of any certificates of occupancy.

Tenant shall report permit status every thirty (30) days to OCII. Failure to timely file and to diligently pursue issuance of permits shall be a breach of this Ground Lease. (b) The Tenant is advised that the Central Permit Bureau will forward all building permits to OCII for approval of compliance with Redevelopment Requirements. Since OCII’s review of Construction Documents is limited (see Section 10.02a, above), its approval of compliance with Redevelopment Requirements is similarly limited and does not include Section 10.02b matters. OCII evidences such compliance by signing the permit and returning the permit to the Central Permit Bureau for issuance directly to the Tenant. Approval of any intermediate permit, however, is not approval of compliance with all Redevelopment Requirements necessary for a full and final building permit.

Issuance of Building Permits. 1) The OWNER covenants and agrees not to apply for a Building Permit in each phase and hereby acknowledges that no building permit will be issued, other than for those model or stock homes described in Section XIII, Clause 12, herein, until the Final Plan is registered for the respective phase, this Agreement is registered, all conveyances required by this agreement have been registered, and a Certificate of Approval has been received from the Ministry of the Environment Conservation and Parks for stormwater management works and the installation of piped water and sanitary sewer systems, where necessary. 2) The OWNER further covenants and agrees that no building, structure or premises on any lands shown in the Final Plan shall be occupied or used as dwelling units until private storm water drain connection(s), if applicable, and a road surface have been properly provided to the satisfaction of the Director of Infrastructure Services of the TOWN. 3) Prior to the issuance of any building permit for any lot or block, the OWNER will obtain an approved entrance permit from the TOWN. The OWNER will construct and install a driveway entrance culvert in the roadside ditch to obtain ingress and egress to and from the lot or block where necessary. Such installation shall be in accordance with the approved OPSS. The maintenance and repair of such culverts shall remain the responsibility of the OWNER until such time as the roads hereinafter referred to have been fully assumed by the TOWN. 4) Prior to issuance of any building permit except those for model or stock homes as permitted in this agreement, the OWNER will provide a Lot Grading Plan showing existing grades and proposed alterations. Such plan shall be approved by the Director of Infrastructure Services and the Chief Building Official of the TOWN. 5) The OWNER agrees to adhere to the recommendations and requirements of the Test Pit Investigation Report, known as Schedule “I” to this Agreement.
