MOST FAVORABLE PRICES AND TERMS. Contractor represents that all prices, terms and benefits offered by Contractor under this Price Agreement are equal to or better than the equivalent prices, terms and benefits being offered by Contractor to any other state or local government unit or commercial customer.

MOST FAVORABLE PRICES AND TERMS. Contractor represents and warrants that all prices, terms and benefits offered by Contractor under this Price Agreement are equal to or better than the equivalent prices, terms and benefits being offered by Contractor to any other state or local government unit or commercial customer. All prices and rates set forth in Exhibit D are firm throughout the Initial Term of the Price Agreement, although price decreases offered by Contractor will be implemented immediately. In the event Contractor desires to request a price or rate adjustment for any Renewal Term, such request must be sent to DAS PS in writing at least 90 days prior to the expiration date of the Initial Term and any subsequent then-current Term. Requests for price or rate adjustments must include sufficient documentation supporting the request. Price increases, if any, must not exceed increases in the Consumer Price Index (CPI), based on the Portland/Salem Urban Consumers percentage adjustment. DAS PS may accept or reject any proposed price increases, if it is in the best interest of the State. Any and all price or rate adjustments, if accepted by DAS PS, shall be agreed to in an amendment made in accordance with Section 7 below. No price or rate adjustment shall become effective until the effective date of the applicable amendment.
