Common use of Natural Disaster/Declared Emergency Clause in Contracts

Natural Disaster/Declared Emergency. ‌ If an emergency is declared by the City, county, state or national authority: 13.8.1 If an employee is called outside of normal working hours, the employee gets time and one half (1½) the normal rate of pay for the first whole shift regardless of the number of hours worked. If the employee is not called from home the regular rules apply (i.e., overtime for hours worked above eight in a day). 13.8.2 Thereafter: the first eight hours at regular rate and 7½% for hours worked between 5:00 p.m. and midnight; 10% for hours worked from midnight to 7:00 a.m. For hours greater than eight in a shift, the employee gets time and one half (1½) the normal rate of pay but no shift differential on those hours above eight.
