Common use of NO STRIKE/NO LOCKOUT Clause in Contracts

NO STRIKE/NO LOCKOUT. Section 1. During the life of this Agreement, the Union and the employees covered under this Agreement, shall not cause, call, or sanction strikes of any kind, including sympathy strikes and strikes in protest of alleged unfair labor practices, boycotts, work stoppages or slowdowns which interfere with the Company’s production or business.

Notwithstanding the foregoing, the Union shall not be barred from engaging in such concerted activity if the Employer fails to pay the wages earned by employees covered by this Agreement or to remit benefit contributions, and to promptly remedy such material breaches of this Agreement upon demand by the Union.

During the term of this Agreement the Employer agrees not to lockout the employees.

The Employer shall not lockout Employees for any reason during the Company’s production or businessterm of this Agreement.

Any violation of the foregoing provision shall be subject to discipline, up to and including discharge.

The Employer agrees not to engage in any kind, including sympathy strikes and strikes in protest lockout during the term of alleged unfair labor practices, boycotts, work stoppages or slowdowns which interfere with the Company’s production or businessthis Agreement.
