Notice of Incident. The District shall not be subject to the duty imposed by Paragraph B of this Article, unless the employee involved shall, within ten (10) days of an occurrence which, reasonably, could be expected to result in a claim or complaint, notify the Superintendent, in writing, of the facts of said occurrence so that a timely investigation may be conducted by the District. Nothing contained herein shall be construed as a bar to an employee exercising his/her rights under the Education Law or any other statute or regulation as may apply, nor shall it be construed as a bar to the Board and the Association agreeing to waive the provisions of this paragraph.

CONTRACTOR, and all subcontractors who will transport hazardous materials, shall give notice after any incident that occurs during transportation, loading, unloading and temporary storage. This notice shall be given verbally within 24 hours of the discovery of the incident. Written notice shall be given within two (2) weeks of the incident. Any incident involving a spill by the carrier shall require the completion and in duplicate of Department of Transportation Form 5800.1 with a copy sent to MWA within two (2) weeks. Contractor shall become aware of, and comply with, all University parking regulations and rules. Contractor and its guests shall be subject to those rules and regulations. No dedicated or reserved parking spaces are available to Contractor. Unless specifically written otherwise above, Contractor is not gaining limited or exclusive access to any parking lots or facilities of the University.
