Common use of Notification of Layoff Clause in Contracts

Notification of Layoff. The following rules shall apply to notification of layoff: 1. When, as a result of the expiration of a specially funded program, classified positions must be eliminated at the end of any school year and classified employees will be subject to layoff for lack of funds, the employees to be laid off at the end of such school year shall be given written notice via certified mail or personal service on or before April 29, informing them of their layoff, effective at the end of such school year. If the termination date of any specially funded program is other than June 30, such notice shall be given not less than sixty (60) days prior to the effective date of their layoff. 2. When, as a result of reduction or elimination of service being performed by any department, classified employees who shall be subject to layoff shall be given written notice of layoff not less than sixty (60) days prior to the effective date of their layoff. 3. Any employee laid off shall be informed of their bumping rights and reemployment rights under this Article. 4. Employees who have bumping rights must provide written notification of their intention to exercise their rights to the District within five (5) workdays after notification of their options or they will forfeit their bumping rights and be placed on the preferential reemployment list. 5. Written notification of layoff/reemployment shall be forwarded to the Association when notifying any unit member of layoff or reemployment.
