February 1976, the Agreement was ratified by Canada, Norway and the Soviet Union, whereby it entered into force 90 days later, i.e. on 26. May 1976. By December 1977, the Agreement had also been ratified by USA and Denmark.21 With the Agreement in place, signed and in time also ratified, it was only binding for the signa- tory parties, i.e. for the Soviet Union, Norway, Denmark, Canada and USA. The Agreement would not be available for other nations to sign and ratify.22 The concerns of possible taking of polar bears by non-signatory nations beyond national land and waters, i.e. in ice-covered international waters, or concerns about such na- tion’s use of Arctic nations’ ports or territory for safari hunting and/or export of polar bear hides and other products, were therefore addressed in the Agreement’s Article VIII, which states: ”Each Contracting Party shall take action as appropri- ate to promote compliance with the provisions of this Agreement by nationals of States not party to this Agreement.” Nevertheless, the IUCN PBSG addressed its concerns over these issues at its 4th meeting in 1974. November 1973. The Governments of the Eastern Republic of Uruguay and the Argentine Republic, motivated by the same spirit of friendship and harmony as characterized the Xxxxxxx-Xxxxx Xxxx Protocol of 1910 and reaffirmed by the Joint Declaration on the Outer Limit of the Río de la Plata of 1961 and the Río de la Plata Protocol of 1964, motivated also by the common desire to remove the difficulties which might arise from any absence of precise legislation with regard to the exercise of their equal rights over the Río de la Plata and from the failure to define the limit between their respective maritime jurisdictions, and determined to lay the bases for broader co-operation between the two countries and strengthen the close bonds of traditional friendship and deep affection that join their peoples, have decided to conclude a treaty which will resolve these issues once and for all according to the special characteristics of the river and maritime territories involved and the technical requirements of their full use and exploitation, within the context of respect for the sovereignty and respective rights and interests of the two States. For this purpose they have appointed as their plenipotentiaries: the Eastern Republic of Uruguay: Xx. Xxxx Xxxxxx Blanco, Minister for Foreign Affairs; and the Argentine Republic: Xx. Xxxxxxx X. Vignes, Minister for Foreign Affairs and Worship, Who, having exchanged their full powers, found in good and due form, have agreed as follows:

Each Holder of this Class R-2 Certificate shall be deemed by the acceptance or acquisition an Ownership Interest in this Class R-2 Certificate to have agreed to be bound by the following provisions, and the rights of each Person acquiring any Ownership Interest in this Class R-2 Certificate are expressly subject to the following provisions: (i) each Person holding or acquiring any Ownership Interest in this Class R-2 Certificate shall be a Permitted Transferee and shall promptly notify the Trustee of any change or impending change in its status as a Permitted Transferee, (ii) no Ownership Interest in this Class R-2 Certificate may be registered on the Closing Date or thereafter transferred, and the Trustee shall not register the Transfer of this Certificate unless, in addition to the certificates required to be delivered to the Trustee under Section 5.02(b) of the Agreement, the Trustee shall have been furnished with a Transfer Affidavit of the initial owner or the proposed transferee in the form attached as Exhibit G to the Agreement, (iii) each Person holding or acquiring any Ownership Interest in this Class R-2 Certificate shall agree (A) to obtain a Transfer Affidavit from any other Person to whom such Person attempts to Transfer its Ownership Interest this Class R-2 Certificate, (B) to obtain a Transfer Affidavit from any Person for whom such Person is acting as nominee, trustee or agent in connection with any Transfer of this Class R-2 Certificate, (C) not to cause income with respect to the Class R-2 Certificate to be attributable to a foreign permanent establishment or fixed base, within the meaning of an applicable income tax treaty, of such Person or any other U.S. Person and (D) not to Transfer the Ownership Interest in this Class R-2 Certificate or to cause the Transfer of the Ownership Interest in this Class R-2 Certificate to any other Person if it has actual knowledge that such Person is not a Permitted Transferee and (iv) any attempted or purported Transfer of the Ownership Interest in this Class R-2 Certificate in violation of the provisions herein shall be absolutely null and void and shall vest no rights in the purported Transferee. Reference is hereby made to the further provisions of this Certificate set forth on the reverse hereof, which further provisions shall for all purposes have the same effect as if set forth at this place. This Certificate shall not be entitled to any benefit under the Agreement or be valid for any purpose unless manually authenticated by an authorized signatory of the Trustee.

  • SBC-12STATE 47.1.1 The terms contained in this Agreement and any Appendices, Attachments, Exhibits, Schedules, and Addenda constitute the entire agreement between the Parties with respect to the subject matter hereof, superseding all prior understandings, proposals and other communications, oral or written between the Parties during the negotiations of this Agreement and through the execution and/or Effective Date of this Agreement. This Agreement shall not operate as or constitute a novation of any agreement or contract between the Parties that predates the execution and/or Effective Date of this Agreement.

  • By December 31, 2015, the Board will calculate the annual amount of a.i) divided by a.ii) which will form the base funding amount for the Trust;

  • Four on, Two off Schedule In an effort to maximize full-time employment opportunities, the local parties may agree to a “four on, two off” innovative schedule, subject to the following principles: (a) The introduction of such schedules and trial periods, if any, shall be determined by the local parties. Each Home must have the majority agreement of the full-time and part- time employees who vote on the issue to agree on a trial period of up to six months. Once the trial period is complete, each Home must have a minimum of 66⅔% agreement of the full-time and part-time employees who vote on the issue to continue with the new schedule on a permanent basis. (b) The implementation of such schedules shall be established only by mutual agreement of the Employer and the Union. (c) Notwithstanding the definition for full-time employee under Article 2.02, employees who participate in this schedule will normally be scheduled for thirty-five (35) hours per week on average and will be considered a full- time employee for all purposes of the collective agreement. i) Notwithstanding Article 16.01, for the purposes of bi-weekly overtime, the normal weekly full-time hours shall remain at seventy-five (75) hours per bi-weekly average over a six (6) week period. In each bi-weekly pay period the employee will be paid for all hours worked. At the end of the six (6) week period, entitlement for bi-weekly overtime will be calculated and paid. ii) Notwithstanding Article 16.01, for the purposes of daily overtime, the normal daily hours shall remain at seven and a half (7.5) hours per day. In each bi-weekly pay period the employee will be paid for all hours worked including daily overtime, if any. (e) For the purposes of vacation entitlement, the current collective agreement provisions shall apply using thirty-five (35) hours per week. (f) Each facility/unit must have eighty percent (80%) agreement of the full- time and part-time employees who work in the facility/unit. (g) The Four on, Two off schedule, may be discontinued by either party upon receipt of twelve (12) weeks’ notice to the other in writing of its desire to terminate. A meeting shall be held within two (2) weeks of receipt of such notice to discuss the reasons for the discontinuation. The Four on, Two off schedule, may be discontinued by the Union in any facility/unit when sixty percent (60%) of the employees in the facility/unit so indicate by secret ballot to the Union.
