NRE. Any equipment, tooling, component, material or other goods or property, which is purchased by Jabil in order to perform its obligations under this Agreement, shall become the property of Company once Jabil is reimbursed for all such NRE Costs. Jabil shall invoice Company for actual outstanding NRE Costs and other monies due at monthly intervals (or such other intervals as deemed appropriate) during the term of this Agreement and upon cancellation, termination or expiration of this Agreement. Jabil agrees to request advance written approval from Company should resource requirements, and thereby NRE Costs, increase materially relative to estimated NRE Costs initially agreed by the Parties. Upon such request, Jabil shall provide to Company reasonably detailed supporting documentation and/or descriptions of the NRE Costs for which Jabil seeks reimbursement.

NRE. Licensee agrees to pay Puma an NRE fee of * as consideration for Puma’s testing of the Translator and development of Intellisync for RIM, as follows: * due April 30, 1998 * due upon delivery of the Intellisync for RIM Golden Master as set forth on Exhibit D. * due upon acceptance of the Intellisync for RIM Golden Master as set forth on Exhibit D. Puma agrees to develop additional PIM support in Intellisync for RIM upon Licensee’s written request on a mutually acceptable schedule for additional NRE fees of * per PIM.
NRE. Following the Parties’ agreement with respect to NRE, NRE charges shall be invoiced by GLOBALFOUNDRIES and paid by Customer pursuant to Section 6. Notwithstanding, NRE known to the Parties as of the Effective Date is set forth in Appendix C. In the event that NRE efforts are cancelled at Customer’s request, unless otherwise mutually agreed in writing, Customer will remain responsible for the originally agreed NRE charges. NRE charges will be invoiced and all undisputed amounts will be due immediately upon cancellation.

The term “NRE” means any non-recurring engineering, design, documentation, supplier and part qualification, training, scheduling, and other relevant charges incurred by Perfect Galaxy in connection with the development, preparation for manufacturing or modification of a part or Product to achieve certain specifications or characteristics, as requested by Satcon from time to time. The Parties agree and acknowledge that Perfect Galaxy’s labor cost for factory assembly and test overhead items such as supervision, supply chain management and logistics, shall not be included in the NRE.
NRE. The Parties shall mutually agree in writing reasonable NRE charges incurred by Perfect Galaxy. Satcon will reimburse Perfect Galaxy for such charges within sixty (60) day after the invoice date.
NRE. Agilent shall make a conditional payment of $1.1 Million NRE to Supplier on the following schedule and based on the conditions listed in Section 4.1(b):
a. No later than seven (7) days after the execution of this Agreement , Agilent shall pay to Supplier an initial $600,000 NRE. Twelve months after the execution of this Agreement, Agilent shall pay Supplier an additional $500,000 NRE, provided the following conditions are met. If any or all of the conditions listed in Section 4.1(b) are not met, Agilent shall not be obligated to pay the $500,000 additional NRE payment.
