Right to Reclaim Sample Clauses

Right to Reclaim. If an employee’s hours are reduced and/or eliminated, the employee will be entitled to reclaim their former position (defined as classification/building/hours) if the hours are increased or the position is reinstated within two (2) calendar years. It shall be the employee’s responsibility to assert reclaim rights. This will apply whether the affected employee displaces another employee, accepts layoff status, remains in position, and/or bids to another position.

Right to Reclaim. If Landlord or any federal, state, or county agency or department determines that it is necessary for the efficient operation of the Airport or to preserve the public health or the environment, then Landlord may terminate this Lease and recover possession of the Premises without penalty, cost, or liability to Tenant. Tenant shall vacate and abandon the Premises within ninety (90) Days after receipt of Notice from Landlord terminating this Lease.
Right to Reclaim. Adopter understands and agrees that Rescue reserves the right to reclaim adoptee if any of the above conditions are not met to the satisfaction of Rescue. Adopter further understands and agrees that Adopter will pay any expenses incurred by Rescue in exercising its rights under this provision in addition to any liquidated damages required by other provisions of this Agreement.

Nothing in this Article prevents Tenant from participating in the public process associated with airport planning. If Landlord reasonably determines that termination is necessary for future expansion or development of the Airport in accordance with the Airport’s Master Plan, then Landlord may terminate this Lease and recover possession of the Premises. Tenant shall vacate the Premises within twelve (12) months after receipt of notice from Landlord terminating this Lease. Landlord’s decision to terminate this Lease is final and non-appealable.

Right to Reclaim. Reclaiming after the Vesting Date. Notwithstanding the terms and conditions as set out in this Agreement, the Recipient expressly agrees that in case he/she engages in conduct or performs acts which are considered as: (i) malfeasance; (ii) fraud; or (iii) specific conduct which has led to the material re-statement of the Company’s annual accounts and/or significant (reputational) harm to the Company, the Company can reclaim the ING Shares delivered to the Recipient under this Agreement. In case, the Recipient chose to sell (part of) his/her ING Shares upon Vesting, the Company reserves the right to receive an amount in Euros equal to the value received by the Recipient at the time of such sale. The Recipient is obliged to repay this amount at first demand by the Company. Whether the Recipient has engaged in such conduct or has performed such acts is at the discretion of the Executive Board of the Company.
Right to Reclaim. The Transfer Partner agrees to notify the XXX Xxxxxx and Transfer Partner Coordinator in the event that the transferred animal has not been placed in a permanent home within six months of transfer from the ARL to the Transfer Partner. In such event, the ARL shall have the right to reclaim the transferred animal. Additionally, the Transfer Partner agrees to return the transferred animal to the ARL, if still in the possession of the Transfer Partner and requested by the ARL, in the event of termination of the Transfer Partner relationship between the ARL and the Transfer Partner.
