The Donation. 3.1 The Contractor supplies the client with a special collection kit, which can be used for the collection of cordblood after birth. This collection kit contains detailed instructions for collecting and shipment of the material. 3.2 Immediately after childbirth 2 blood tubes will be filled with blood from the mother. These blood tubes will be send, with the collection kit, to SCBN. SCBN will send these tubes to Sanquin to be tested on infection parameters (HIV 1 and 2, hepatitis B and C, and syphilis). SCBN informs the parents about these results. 3.3 Immediately after childbirth the Client contacts the Contractor. The Contractor arranges the shipment of the cordblood to the Foundation, which is to receive the cordblood.
The Donation. In 1985, a $150,000 donation was made to the ALP by the then chairman of Parry Corporation Limited, Mr Xxxxx Xxxxx. Half of that donation was financed, effectively, by the Superannuation Board from trust money that had been paid by contributors to the superannuation fund.

The Donation. The Donor agrees to send the money as follows: o Using the list and the information provided by the Oversite Committee, Donor will farther select the most affected farmers to ensure sufficient distribution of money based on the total money budgeted for this project. o Donor will allocate a maximum of $100 and a minimum of $80 Canadian dollars to be paid to each farmer based the extent of damage provided by the Oversite Committee. o Donor will divide the list in three groups in the order that the money is to be remitted; first, second and third batch. o Donor will send the Oversite Committee list of qualified farmers showing the allocated money for each farmer. o Donor will remit the funds in three installments as shown in section IV, to Commercial Bank of Ethiopia, Chercher Branch, Chercher, Tigray Region, account No. 1000347827766 o After receiving the first instalment, the Oversite Committee will pay each farmer in the first batch, her or his allocated share by Xxxxxx. If cheques are not available, the Oversite Committee will issue vouchers in a form of a letter which bears their organization seal instructing the bank to pay each qualified farmer her or his allocated amount.
The Donation. 5.16.1 At all material times, as contemplated by Clause 4.3(b) of the joint venture agreement, the Halls Head joint venture maintained an account at the Metropolitan Markets branch of the R & I Bank. The account was in the joint names of Esplanade Mandurah and Perpetual Trustees as trustee for the SB Investment Trust. At all material times, the account was under the practical control of the Parry group. 5.16.2 At all material times, Xx Xxxxx was the dominant person within Esplanade Mandurah and the Parry group as a whole. Xx Xxxxx was Chairman and Chief Executive of Parry Corporation, which was the holding company of the group. Xx Xxxxx, through Paracel Pty Ltd ("Paracel"), controlled Parry Corporation. Mr Xxxxx and Xx Xxxxx Xxxxxxx were part-time employees of the Parry group during the relevant period. Xx Xxxxxxxx Xxxxxxx was a full-time employee, but he was undoubtedly subordinate to Xx Xxxxx, and subject to instructions and directions from him. 5.16.3 Xx Xxxxx was the chief decision-maker within the Parry group. At times Xx Xxxxx was autocratic in relation to Parry Corporation. His will generally prevailed. If Xx Xxxxx gave an instruction to anyone in the Parry group which was capable of being carried out, the instruction was carried out. There is evidence before the Commission of Xx Xxxxx having told his subordinates within the Parry group that decisions affecting finance were not to be made without reference to him. Xx Xxxxx could not tell the directors of Parry Corporation what to do, but he could get rid of them. 5.16.4 In late July 1985, a cheque for $150,000 was drawn on the Halls Head joint venture account. The payee of the cheque was the No 1 Advertising Account. The cheque was presented to the Premier, Xx Xxxxx, as a donation to the Australian Labor Party, and was deposited by Xxx Xxxxxx Xxxxx (Ministerial Officer, Office of the Premier) in the No 1 Advertising Account at the Town & Country Building Society. 5.16.5 The practical effect of paying the $150,000 from the Halls Head joint venture account was that the donation was financed as to $75,000 by Esplanade Mandurah, and as to $75,000 by the Board. The $75,000 that was effectively financed by the Board was, of course, trust money that had been paid by contributories to The Superannuation Fund. 5.16.6 At all material times, Esplanade Mandurah had four directors, namely, Xx Xxxxx, Xx Xxxxxxx, Mr Xxxxx and Xx Xxxxxxx. The Donation. 2.1. The founder hereby donates to the first trustees the sum of R100,00 on the terms and conditions hereinafter set out. 2.2. The donation shall immediately vest in the first trustees.

Donor represents and warrants that it has all ownership rights and full authority to transfer and convey the Donation to the City. 2.4 The City agrees to arrange for access to and make all provisions for Donor to enter upon real property as required for Donor to install the Donation. 2.5 The Donor acknowledges and understands that the City will not extend or offer any advantages, approval, or benefits to the Donor in exchange for the Donation. 2.6 Donor warrants to City that the Donation will be fit for the particular purpose for which it is intended to be used, of good workmanship, and free from defects.
