(b) All employees who are entitled to four (4) or more weeks at eight percent vacation shall not be permitted to take more than three (8%3) weeks during the period beginning June 1st and ending September 30th, inclusive, unless otherwise specially agreed upon between the Company, the Union and the employee.

PAID VACATIONS. 16.01 For the purpose of calculating vacation entitlement, an employee's service date shall be his or her start date with the company or as required by the Employment Standards Act.
16.02 An employee in the active employ of the Company shall be entitled to an annual paid vacation on the following basis:
(a) Employees having less than one (1) year of service shall receive vacation pay onlypay, in accordance with the provisions of the Employment Standards Act.
(b) An employee with more than twelve (12) months continuous service with the Company shall be entitled to two (2) weeks vacation at four percent (4%) of his gross earnings.
(c) An employee with five (5) years or more of continuous service with the Company shall be entitled to three (3) weeks vacation at six percent (6%) of his gross earnings.
(d) An employee with ten (10) years or more of continuous service with the Company shall be entitled to four (4) weeks vacation at eight percent (8%) of his gross earnings.
(e) An Effective November 30, 2004 an employee with twenty (20) years or more of continuous service with the Company shall be entitled to five Five (5) weeks vacation at ten percent (10%) of his gross earnings.
16.03 16.02 For the purposes of determining increased vacation entitlement, the appropriate date shall be the Officers' anniversary date of each year.
16.04 16.03 An employee who leaves the service of the Company shall be given the vacation pay to which he was entitled at the time he left the service of the Company.
16.05 16.04 Vacation time is not cumulative and must be taken by in accordance with the conclusion provisions of the ESA. Accrued vacation year.time in excess of the time taken in accordance of the ESA shall be allowed to accumulate for up to 3 calendar years
16.06 16.05 Requests for vacation time shall be made in writing to the Company's Operations Office at least thirty fifteen (3015) calendar days in advance of the start of the vacation. The Company will provide written confirmation of all vacation requests within one five (15) week business days of receiving the original vacation request. Vacation pay shall be paid on the pay pay-day immediately preceding the start of the employee's vacation, or as otherwise requested by the employee provided the request is made within the payroll cycle cut-off time limits.
16.07 Fifteen 16.06 Twenty-five percent (1525%) of employees per classification per site will be allowed to take vacation at one time provided staffing on site is fifteen (15) Officers or less. If staffing exceeds fifteen (15) Officers, the percentage will be ten twenty (1020%) percent per site per shift.
16.08 . Vacation pay will be paid upon written request of any employee, one time for each week of entitlement.maximum twice per calendar year

16.09 Any employee who falls ill or is injured during their vacation period shall be considered to be on sick leave during the period of such illness and therefore the unused portion of his vacation period shall be returned to his vacation accrual time provided the Employee can prove such illness or injury with a medical certificate. No part of this clause shall be deemed to include monetary compensation to be paid by the Company to the affected Employee.
