Pay Upon Termination. Upon termination of employment, employees will be paid for all earned but unused vacation providing the employee has completed a minimum of one (1) year of seniority. This payment cannot exceed the maximum accrual allowed.
Pay Upon Termination. When an employee is terminated by the employer, the employee's wages, including longevity earnings to time of termination, shall be paid within 72 hours. When the employee terminates their employment, the employee wages will be paid on the next regular bi-weekly payday.

(a) If and to the extent vacation pay has been earned but not paid at the time of an employee’s voluntary termination of employment, and if the employee gave the Employer at least fourteen (14) calendar days’ advance written notice before such termination, then such earned vacation pay will be paid to the employee upon termination; provided, however, that paid vacation days may not be used to satisfy the advance notice requirement. Notwithstanding the above provisions of this section, the Employer may in its sole discretion waive the fourteen (14) calendar day notice requirement under extenuating circumstances.
(b) In the event of an employee’s death, any unused paid vacation for which the employee was eligible shall be paid to the named beneficiary or, in the absence of such designation, to the personal representative of the employee’s estate.
(c) No vacation pay shall be made to employees upon discharge for gross misconduct.
Pay Upon Termination. If Executive is terminated by the Company without Cause, and providing the Executive executes a general release of claims against the Company and is otherwise in compliance with the terms of this Agreement, the Company will pay Executive the following compensation:
(a) If the Executive has been employed in his position with the Company for up to three (3) years, the Company will pay the Executive an amount equivalent to six (6) months of Executive’s Base Compensation immediately prior to termination;
(b) If Executive has been in his position with the Company for more than three (3) years, but less than six (6) years, the Company will pay the Executive an amount equivalent to twelve (12) months of Executive’s Base Compensation;
(c) If Executive elects COBRA continuation upon termination of employment, Company will pay Executive for the Employer’s portion of the premium cost during the time Executive remains eligible under COBRA and is receiving Base Compensation under either paragraph (a) or (b) of this Section 6.4, the method of such payment to be determined by the Company.
(d) After six (6) years of employment, the Company will pay no compensation to Executive upon termination.
(e) Bonuses earned but unpaid at the termination date will be at the discretion of the Board. Bonuses will not be prorated for a partial year.
(f) The method of payment, whether lump sum or periodic, will be at the sole discretion of the Company. Nothing in this Section will operate as a guarantee of employment for any particular term.
Pay Upon Termination. (Separation of Employment) means only the equipment rental will not be paid in accordance with this Section (Article 63 of Part II—Truckaway, of this Supplemental Agreement).
