Partial Absences. The law provides that leave can be taken intermittently or on a reduced schedule. Thus, employees may take leave in non-continuous increments, e.g., every afternoon, two days per week, one week each month, etc. a. Family leave for birth, adoption or xxxxxx care can only be taken on an intermittent or reduced basis if the employer and employee agree. b. Medical leave may be scheduled as medically necessary. c. An employer may temporarily transfer an employee taking intermittent or reduced schedule leave to a position more suitable for recurring periods of absence to better accommodate the leave. Employees cannot be penalized by the transfer. Therefore, the wages and benefits must remain the same.
