Market Value We will indemnify You the insured value or the market value of the insured property whichever is lower subject to the deduction of any Excess. Market value means the value of the property insured at the time of loss or damage less allowance for wear and tear and/or depreciation. The market value shall be determined by a valuation obtained by Us from the:  manufacturer, or  authorised sole agent or agent, or  authorised broker, authorised distributor, or  building contractor , or  loss adjuster registered under the Financial Services Act 2013, or  Registered Valuer under the Valuers, Appraisers and Estate Agents Act 1981 to be mutually appointed by both You and Us. The valuation so obtained shall be conclusive in any legal proceedings against Us. SERVICE TAX CLAUSE Important Notice: Please be informed that Service Tax will be implemented by the Government of Malaysia with effect from 1 September 2018 at a rate of six (6) per centum. Progressive Insurance Bhd reserves the right to collect from you an amount equivalent to the Service Tax payable on the applicable premium for the policy period, or in the event that the policy period commences before but expires after 1st September 2018, to collect from you an amount equivalent to the Service Tax payable on the applicable premium calculated from 1 September 2018 on a pro-rated basis. Your obligation to pay Service Tax shall form part of the Terms and Conditions in your insurance policy. In addition, in the event that (i) the applicable portion of the Lower Tier Distribution Amount shall be insufficient to pay all interest due and payable on the related Lower Tier Regular Classes on such Distribution Date or (ii) such Distribution Date is a Final Distribution Date for any Class and the distribution on such Distribution Date of the applicable portion of the Lower Tier Distribution Amount will not be sufficient to reduce the Class Balance of such Class to zero on such Final Distribution Date, then Xxxxxx Xxx shall (a) withdraw from the Certificate Account, such amount as shall be necessary to remedy such insufficiency and (b) to the extent that funds in the Certificate Account shall be insufficient therefor, apply its own funds towards remedying the same.

  • Excess Payments If Tenant shall assign this Lease or sublet any part of the Premises for consideration in excess of the pro-rata portion of Rent applicable to the space subject to the assignment or sublet, then Tenant shall pay to Landlord as Additional Rent 50% of any such excess immediately upon receipt.
