Physician Executive(s). Within 60 days of the Effective Date, KDMC shall appoint, and maintain for the term of the CIA, at least one but no more than three Physician Executive(s). The Physician Executive(s) shall be responsible for oversight of medical staff quality of care matters at KDMC, including but not limited to performance improvement, quality assessment, patient safety, utilization review, medical staff peer review, medical staff credentialing and privileging, and medical staff training and discipline. The Physician Executive(s) shall be members of senior management of KDMC, shall make periodic (at least quarterly) reports regarding quality of care matters directly to the Board of Directors of KDMC, and shall be authorized to report on such matters to the Board of Directors at any time. The total amount of time devoted by the Physician Executive(s) to these tasks shall be, at a minimum, the equivalent of one full time employee. KDMC shall report to OIG, in writing, any changes in the identity or position description of the Physician Executive(s), or any actions or changes that would affect the ability of the Physician Executive(s) to perform the duties necessary to meet the obligations in this CIA, within 15 days after such a change.

The Physician Executive(s) shall be responsible for oversight of medical staff quality of care matters at Allegiance, including but not limited to performance improvement, quality assessment, patient safety, utilization review, medical staff peer review, medical staff credentialing and privileging, and medical staff training and discipline. The Physician Executives(s) shall be members of senior management of Allegiance, shall make periodic (at least quarterly) reports regarding quality of care matters directly to the Governing Board of Allegiance, and shall be authorized to report on such matters to the Governing Board of Allegiance at any time. The total amount of time devoted by the Physician Executive(s) to these tasks shall be, at a minimum, the equivalent of one full-time employee. Allegiance shall report to OIG, in writing, any changes in the identity or position description of the Physician Executives(s), or any actions or changes that would affect the ability of the Physician Executive(s) to perform the duties necessary to meet the obligations in this CIA, within 15 days after such a change. Notwithstanding any other provision under this CIA, if Allegiance is unable to fully comply with this Section III.A.3 at any point in time during the term of the CIA, Allegiance shall have 90 days to recruit and appoint Physician Executives(s) in order to comply with this Section III.A.3. If Allegiance is not in compliance with this Section III.A.3 by the end of the 90 day time period, the OIG may, at its sole discretion, grant additional extensions pursuant to timely requests for extensions under Section X.B of the CIA or seek stipulated penalties in accordance with Section X.A.l of the CIA.
