- POLICE AND REGULATORY POWERS. The Licensee's rights are subject to the powers of the Town to adopt and enforce general bylaws/ordinances necessary for the safety and welfare of the public, provided that such bylaws/ordinances are of general applicability and not specific to the Cable Communications System, the Licensee, or this License.
- POLICE AND REGULATORY POWERS. By executing this Renewal License, the Licensee acknowledges that its rights are subject to the powers of the Town to adopt and enforce general by-laws necessary to the safety and welfare of the public. The Licensee shall comply with all applicable by-laws and/or regulations enacted and/or amended by the Town. Any conflict between the terms of this Renewal License and any present or future lawful exercise of the Town's police and regulatory powers shall be resolved in favor of the latter.
- POLICE AND REGULATORY POWERS. (a) By executing this Renewal License, the Licensee acknowledges that its rights are subject to the powers of the Town to adopt and enforce general by-laws necessary to the safety and welfare of the public. The Licensee shall comply with all applicable Department of Public Works regulations, and any lawful by-laws and/or regulations enacted and/or amended by the Town. Any conflict between the terms of this Renewal License and any present or future lawful exercise of the Town's police and regulatory powers shall be resolved in a court of appropriate jurisdiction.
(b) The Issuing Authority shall notify the Licensee of any proposed changes in by-laws and/or regulations pertaining to any material aspect of the Cable System operation hereunder, and shall provide copies of such proposed by-laws to the Licensee upon the Licensee’s written request.
- POLICE AND REGULATORY POWERS. Nothing herein contained shall limit County's ability to exercise its police and regulatory powers or its powers of eminent domain.

Franchisee’s rights are subject to the powers of the Town to adopt and enforce general ordinances necessary for the safety and welfare of the public, provided that such ordinances are of general applicability and not specific to the Cable System, the Franchisee, or this Renewal Franchise, including ordinances and regulations pertaining to management, control and regulation of public rights-of-way but only to the extent authorized or allowed by state law and federal law, and to the extent such exercise does not conflict with the exercise by Franchisee of the rights granted hereunder. Any conflict between the terms of this Renewal Franchise and any present or future exercise of the Franchising Authority’s police and regulatory powers shall be resolved by a court of appropriate jurisdiction.

Franchisee’s rights are subject to the powers of the Town to adopt and enforce general ordinances necessary for the safety and welfare of the public, provided that such ordinances are of general applicability and not specific to the Cable System, Franchisee, or this Franchise, including ordinances and regulations pertaining to management, control and regulation of public rights-of-way but only to the extent authorized or allowed by State law and federal law. Any conflict between the terms of this Franchise and any present or future exercise of the Franchising Authority’s police and regulatory powers shall be resolved by a court or governmental agency with appropriate jurisdiction. Nothing in this Section 2.10 shall be deemed a waiver of any rights or defenses that Franchisee may have under Applicable Law.

By executing the Renewal License, the Licensee acknowledges that its rights are subject to the powers of the Town to adopt and enforce general by-laws necessary to the safety and welfare of the public. The Licensee shall comply with all applicable State and Town laws, by-laws of general applicability, and not specific to this Renewal License, the Cable System or the Licensee, rules, and regulations governing construction within a Public Way and shall apply all of such standards to construction within a private way in the Town, unless legally prevented from applying such standards in private ways. Any conflict between the terms of the Renewal License and any present or future lawful exercise of the Town's police and regulatory powers shall be resolved in a court of competent jurisdiction.
- POLICE AND REGULATORY POWERS. By executing the License, the Licensee acknowledges that its rights are subject to the powers of the Town to adopt and enforce general by-laws necessary to the safety and welfare of the public. The Licensee shall comply with all applicable State and Town laws, by-laws of general applicability, and not specific to this License, the Cable System or the Licensee, rules, and regulations governing construction within a Public Way and shall apply all of such standards to construction within a private way in the Town, unless legally prevented from applying such standards in private ways. Any conflict between the terms of the License and any present or future lawful exercise of the Town's police and regulatory powers shall be resolved in a court of competent jurisdiction.
- POLICE AND REGULATORY POWERS. (a) By executing this Final License, the Licensee acknowledges that its rights are subject to the lawfully exercised powers of the Town to adopt and enforce by-laws and regulations, not specific to the Licensee, relative to the safety and welfare of the public. The Licensee shall comply with all applicable laws and regulations. Any conflict between the terms of this Final License and any such lawful exercise of the Town's police and regulatory powers shall be resolved in favor of the latter.
(b) The Licensee shall comply with all applicable laws governing construction within a Public Way and shall apply all of such standards to construction within a private way in the Town.
(c) Nothing in this Final License shall be construed as a waiver of any bylaw or regulation of the Town of Stoneham or of the Town’s right to require the Licensee or any person utilizing the infra- structure of the Town of Stoneham to secure the appropriate permits or authorizations for such use.
(d) Nothing in this Final License shall be construed as a waiver or release of the rights of the Town in and to the public ways. In the event all or part of a public way within the Town is abandoned or discontinued, all rights and privileges granted pursuant to this Final License with respect to such street, or any part thereof so abandoned or discontinued, shall cease upon the effective date of such abandonment or discontinuance, provided that, if such abandonment or discontinuance is undertaken for the benefit of any private person, the Town shall, as appropriate, condition its consent to such abandonment or discontinuance of such street on the agreement of such private person to grant the Licensee the right to continue to occupy and use such street or reimburse the Licensee for the reasonable cost to relocate the affected part of the cable system.
(e) Nothing herein shall prevent the Town from assessing taxes on the Licensee’s Cable System and/or plant in accordance with applicable law.

The Licensee’s rights are subject to the powers of the City to adopt and enforce general bylaws/ordinances necessary for the safety and welfare of the public, provided that such bylaws/ordinances are of general applicability and not specific to the Cable Television System, the Licensee, or this License. The Licensee shall comply with all federal, state and local laws/ordinances and charter provisions and rules of the Department of Public Works as now existing or hereinafter amended. Any conflict between the terms of this Renewal License and any present or future lawful exercise of the City’s police and regulatory powers shall be resolved in favor of the latter.
