Common use of Positions Temporarily Vacant Clause in Contracts

(a) The Employer agrees that, except in the case of emergency, an employee's work load will not be increased as a result of positions being temporarily vacant due to illness, vacation, leave of absence, or any other reasons. (b) In such instances, the Employer shall give qualified permanent employees the opportunity to substitute in higher paying positions and arrange for staff replacements at the lowest paying category. Such substitution shall be on a seniority basis within the next lowest classification in which a qualified employee can be found.
