Common use of Positions Temporarily Vacant Clause in Contracts

Positions Temporarily Vacant. (a) The Employer agrees that except in the case of emergency, an Employee’s workload will not be increased as a result of positions being temporarily vacant due to illness, vacation, leave of absence, or any other reason. Disputes arising out of this Article shall first be referred to the Employee’s supervisor. Failing resolution within three (3) work days, the matter shall be referred to the Labour/Management Committee. (1) In such instances, the Employer shall give qualified regular Employees the opportunity to substitute in higher paying positions and arrange for staff replacements at the lowest paying category. Such substitution shall be on a seniority basis within the next lowest classification in which a qualified Employee can be found. (2) The provisions of Article 35.2 shall apply.
