In the event changes in law, regulations or systems create new jobs if they are defined as within the bargaining unit pursuant to Article 1 and which the Employer chooses to implement, those jobs will be offered to employees within the collective bargaining unit in accordance with Section 5.1 with appropriate consideration for employee qualifications and seniority in accordance with Article 6, Seniority. Where a present employee and an outside applicant have, in the opinion of management, relatively equal qualifications for the job, preference shall be given to the present employee. Where two present employees are equally qualified for the job, in the opinion of management, preference shall be given to the senior employee.
