Qualifications and Seniority. When qualifications among candidates are relatively equal, seniority shall be the determining factor. Under no circumstances may a junior employee grieve the selection of a senior employee. For the purposes of this section, “qualified” shall be interpreted to mean:
Qualifications and Seniority. Awarding a position in a new classification and/or a position in another department will be based on qualifications and if qualifications are substantially equal, seniority will be the determining factor. In the case of an employee who has received a final warning or suspension for either gross misconduct or a major violation of the work rules within the six (6) month period immediately preceding the posting of the open and available position, management may determine not to award the position to said employee, whom may be otherwise be qualified.

When ability and qualifications are equal among the applicants, the bargaining unit member with the longest seniority in the bargaining unit shall be selected and given a trial period, not to exceed thirty (30) actual working days, to determine if he/she is capable of performing the work. During the trial period, the School District may disqualify the employee at any time and no grievance shall arise, but the employee shall be allowed to return to his/her original position. A conference will be held at the employee's request to discuss the disqualification. Once an employee has voluntarily chosen to transfer to an open position, he/she will have ten (10) business days to choose to return to his/her previous position. The previous position will not be posted until after the ten (10) business days.
