Pre-Approval Notice. Promptly following execution of the Agreement, Class Counsel shall file a motion with the Superior Court of Quebec for approval of the Pre-Approval Notice and shall seek to obtain the Pre-Approval Order.
Pre-Approval Notice. If Global is contacted by a Person interested in a project that will process Household Waste using the Technology or if Global is interested in pursuing potential projects that will process Household Waste using the Technology in a particular geographic area, Global shall have the right to notify Covanta, in writing, about the project opportunity (a “Pre-Approval Notice”) and ask Covanta to confirm, in writing, whether it agrees that a project to process Household Waste using the Technology in such geographic area will qualify as a Carve-Out Project. Covanta shall not unreasonably withhold such confirmation and shall respond to each such Pre-Approval Notice in writing within thirty (30) days of the receipt thereof. If Covanta fails Execution Copy 6 to respond to any Pre-Approval Notice within such thirty (30) day period, such failure shall be deemed to be an approval.
Pre-Approval Notice a) The Settlement Class will be notified of the date of the Settlement Approval Application by way of the Pre-Approval Notice. The Court will be asked to approve the Pre-Approval Notice substantially in the forms attached hereto as Exhibits SET-11 and 12. Subject to approval of the Court, the Claims Administrator shall cause the Pre-Approval Notice to be published and distributed in the manner described in the Notice Program attached as Exhibit SET-7 by a date to be set by the Court.
Pre-Approval Notice. All Market Inc. shall, at its sole expense, notify Class Members of the Agreement by way of a Pre-Approval Notice which states inter alia: (i) that the Agreement will be submitted to the Superior Court of Quebec for approval, specifying the date and place of such proceedings; (ii) the nature of the Agreement and the method of its execution; (iii) the procedure to be followed by the Class Members to prove their Claims; and (iv) that the Class Members have the right to present their arguments to the Court as regards the Agreement. Attached as Schedule B is the proposed Pre-Approval Notice.
Pre-Approval Notice. Within 10 days of the date of issuance of the Pre-Approval Order, or on the date fixed by the Court in that regard, Class Counsel shall post the Pre-Approval Notice in both English and French on its Facebook page and website for a period of at least 30 days, as well as in the online registry of class actions offered by the Superior Court of Quebec, and will email the content of the Pre-Approval Notice in both English and French to each person who has registered on Class Counsel’s website to receive information regarding the Class Action.
Pre-Approval Notice. Within three (3) business days of the Certification Date, the long-form Pre-Approval Notice will be posted on the websites of Canadian Class Counsel at xxx.xxxxxxxxxxx.xx and U.S. Lead Plaintiffs’ Counsel at xxx.xxxxxxxxx.xxx, and xxx.xxxxxxx.xxx. Within that same period, the long-form Pre-Approval Notice and Proof of Claim form will also be posted on the website established by the Claims Administrator for purposes of administering the Settlement. The Pre-Approval Notice will also be disseminated as follows: Publication of the short-form Pre-Approval Notice, which notice will be at least 1/8 of a page in size, will occur within fourteen (14) days of the mailing of the long form Pre-Approval Notice and Claim Form described below. In Canada, such publication will be made in the English language in the national editions of the National Post and Globe and Mail and in the French language in La Presse. The English and French language versions of short-form Pre-Approval Notice will also be issued across Marketwire, a major business newswire in Canada. In the U.S., such publication will be made in the English language only in the national edition of Investor’s Business Daily, and by issuance of the short-form Pre-Approval Notice across Business Wire, a major national business newswire in the U.S. In addition to print and wire publication, SCAS will be requested to issue a "securities class action alert" advising its institutional investor clients of the certification of the Actions for settlement purposes only, the deadlines for opting-out and objecting to the Settlement, and the time and place of the Canadian and U.S. approval hearings. A request will also be made to CDS to issue a bulletin to all brokerages participating in the CDS system, which bulletin will contain the long-form Pre-Approval Notice and Proof of Claim and a request from the Courts that each participating brokerage forward a copy of such notice and Proof of Claim to any investors or non-member brokerages who purchased Royal Group securities through the participating brokerage during the Class Period.
Pre-Approval Notice. As part of the Settlement Cap, New Balance shall pay the costs to notify Class Members of the Agreement by way of a Pre-Approval Notice which states inter alia: (i) that the Agreement will be submitted to the Superior Court of Quebec for approval, specifying the date and place of such proceedings; (ii) the nature of the Agreement and the method of its execution; (iii) the procedure to be followed by the Class Members to prove their Claims; (iv) that the Class Members have the right to present their arguments to the Court as regards the Agreement; and (v) the procedure to be followed in order to file and Opt Out Form on or before the Opt Out Deadline. Attached as Schedule B is the proposed Pre-Approval Notice.
Pre-Approval Notice. Summary notices in English and French shall be published in accordance with the directions of the Court in the Pre-Approval Order. Summary notices, substantially in the form attached as Schedule E, shall also be mailed, by prepaid regular mail, to all potential Settlement Class Members (i) for whom VGCA has only a valid mailing address, and (ii) who have contacted Class Counsel and provided only a mailing address as their contact information. A long-form notice, substantially in the form attached to as Schedule F to this Settlement Agreement, may also be posted to the Settlement Website.
Pre-Approval Notice. The Claims Administrator shall notify Class Members of the Settlement Agreement by way of a Pre-Approval Notice which states, inter alia: (i) that the Settlement Agreement will be submitted to the Quebec Court for approval, specifying the date and place of such hearing but stating that the date may change and will be posted only on the Settlement Website; (ii) the nature of the Settlement Agreement and the method of its execution; (iii) the procedure to be followed by the Class Members to file their Claims; (iv) that Class Members have the right to object to the Settlement Agreement and present their arguments to the Quebec Court; (v) the procedure to be followed in order to Opt-Out of the Settlement Agreement before the Opt-Out Deadline; (vi) directing Class Members to the Settlement Website; and (vii) providing instructions for contacting the Claims Administrator to obtain a paper Claim Form or otherwise.
Pre-Approval Notice. Pursuant to section 10.4 of the Settlement Agreement, summary notices substantially in the form as set out in Exhibit 2, shall be published once in the following newspapers, in either English or French, as is appropriate for each newspaper, in a size no less than 1/8 page, subject to each having reasonable publication deadlines and costs:
