Common use of Pregnant Employee's Rights Clause in Contracts

Pregnant Employee's Rights. (a) The Employer may require the Employee to commence leave of absence without pay where the Employee’s position cannot be reasonably performed by a pregnant woman or the performance of the Employee’s work is materially affected by the pregnancy. Such action shall not be taken until the Employee has been advised of the Employers concern and provided the opportunity to provide medical evidence establishing their ability to work.
