Preventive and Corrective Maintenance. DBS will perform Preventive Maintenance and Corrective Maintenance. Preventive Maintenance is the implementation of a change in the Eurex Software to improve existing functionality or performance prior to a problem in production becoming apparent. Corrective Maintenance is the implementation of a change in the Eurex Software to correct a problem after it has become apparent in production.
Preventive and Corrective Maintenance. Upon receipt of an item of Covered Equipment, Itron shall (i) perform preventative Maintenance Services necessary to maintain the Covered Equipment in Operating Condition, and (ii) diagnose and correct any failure in the Covered Equipment as necessary to meet Operating Condition, excluding minor cosmetic deficiencies such as blemishes, dents or scratches.
Preventive and Corrective Maintenance. The Operator acknowledges that the continuous operation of the Facility is essential, especially during day hours therefore the work of repairs, maintenance, rebuild and tests must be planned in a such a way that interruptions to the Facility operation are kept to a minimum and as a consequence he will apply a higher standard of diligence to perform during night hours to the extent possible in order to minimize interruptions and maximize production. The Operator will provide all materials, tools, staff and labour requirements, as well as its staff expenses, etc. in order to carry out the tasks, except otherwise agreed in this Agreement.

1.2 Either DBAG or Ceres can initiate Preventive Maintenance or Corrective Maintenance by submitting a System Investigation Request to the other party (in each case with a copy to the Eurex Entities) in which the problem and, to the extent reasonably feasible, the appropriate corrective measures are described. In the case of Corrective Maintenance, the initiating party will also classify the problem according to the following criteria:
Class 1: The problem prevents the Licensed Programs as a whole from operating or would have such an impact on the operation that the use in production is not commercially viable.
