Professional Independence. The content of Guest Expert’s participation is within the sole discretion of Guest Expert. Guest Expert shall make every effort to provide current and accurate information to Program Participants, but does not guarantee the same. The Organizer expressly acknowledges that the opinions of the Guest Expert are independent and subject only to her professional judgment.

Professional Independence. An effective means of securing professional independence for defender organizations is to place responsibility for governance in a board of trustees. Assigned-counsel and contract-for-service components of defender systems should be governed by such a board. Provisions for size and manner of selection of boards of trustees should assure their independence. Boards of trustees should have the power to establish general policy for the operation of defender, assigned-counsel and contract-for- service programs consistent with these standards and in keeping with the standards of professional conduct. Boards of trustees should be precluded from interfering in the conduct of particular cases. A majority of the trustees on boards should be members of the bar admitted to practice in the jurisdiction. Commentary [to Standard 5-4.1]: Independence of the chief defender and staff is fundamental to both the fact and appearance of zealous representation of the accused. As noted in standard 5-1.3, one means of assuring independence for a defender organization is to create a board of trustees with overall responsibility for the general policies of the program and selection of the chief defender…. What is not deemed satisfactory is for the chief defender to be chosen by judges, because that method fails to guarantee that the program will remain free of “judicial supervision.” Even with the best of motives by both judges and defenders, the appearance of justice is tarnished when the judiciary selects the chief defender or exercises control over the hiring of staff. Professional Independence. Notwithstanding any other tenn or provision of the Plan or this Agreement, it is understood that the Dental Provider retains the right to exercise full discretion as a licensed dentist in determining whether, and to what extent, dental services are required to be perfonned for any enrollee and the Dental Provider at all times shall remain independent of, and not employees of, nor under the control, supervision or management of the Dental Coordinator or any other parties to the Dental Plan. At all times, the Dental Provider shall maintain a doctor-patient relationship with each Enrollee and nothing contained in this Agreement is intended to interfere with or infringe upon such relationship, nor in the maintenance of ethical standards and duties required to be perfonned by the Dental Provider in the care and treatment of his patient, except that the Dental Provider agrees to periodic quality audits of his professional standards of dental care which may be conducted from time to time by qualified, licensed dentists selected by the Dental Director and, in the event of a dispute regarding the adequacy of dental care rendered by the Dental Provider, the Dental Provider shall abide by the instructions and recommendations of the peer review dentist or group of dentists, it being the intention of all parties that the Dental Provider shall at all times be required to maintain a high standard of professional care for all enrollees under the Plan.
Professional Independence. Scientific independence: Statistics authorities must be able to carry out their activities according to the principle of scientific independence, particularly vis-a-vis the political authorities or any interest group; this means that the methods, concepts and nomenclatures used in statistical operation shall be selected only by the Statistics authorities without any interference whatsoever and in accordance with the rules of ethics and good practice.

  • Professional Dues The school district will pay the annual dues for the Superintendent’s membership in the American Association of School Administrators, Association for Supervision and Curriculum Development, and Nebraska Council of School Administrators.
