Project Conditions Regarding Offsite Intersection Improvements. It shall be a condition to the City’s issuance of building permits for the Project that the Developer shall pay its Fair Share Contribution Requirement for the “Intersection and Street Improvements” as defined in and set forth on Exhibit L-2 attached hereto. Any Intersection and Street Improvement Improvements over which Caltrans has jurisdiction shall require coordination and detailed design review with Caltrans to determine the feasibility of the improvement. For any intersections or street segments requiring additional right-of-way, the Developer shall be responsible for payment of the acquisition (capped at $3,000,000.00 (three million dollars) in total for all acquisitions), however, the City shall be responsible to secure the additional right-of-way for same. Subject to reimbursement from other projects that are also required to pay the Fair Share Contribution Requirement for the Intersection and Street Improvements, including the payment for acquisition of additional right-of-way, the Developer shall work with City and use its best efforts to ensure that as many as the above referenced Intersection and Street Improvements are funded and completed prior to issuance of any Certificate of Occupancy for the buildings within PA3(a).

  • Site Improvements The City may require a Developer to undertake site improvements upon completion of construction. Site improvements include, but are not limited to, seeding or sodding of front yards, and 4' chain-link fencing. Said site improvements must be undertaken when seasonally appropriate. The City reserves the right to make an exception on a case-by-case basis.

  • Notice to Proceed - Site Improvements The Recipient shall not commence, or cause to be commenced, any site improvements or other work on the Land until the Director has issued a Notice to Proceed to the Recipient. Such Notice to Proceed will not be issued until the Director is assured that the Recipient has complied with all requirements for the approval of a grant under Revised Code Sections 164.20 through 164.27 and has completed any land acquisition required by the Project. A Notice to Proceed shall be required for all Project prime contractors or direct procurement initiated by the Recipient following execution of this Agreement.

  • School Improvement Plans The School shall develop and implement a School Improvement Plan as required by section 1002.33(9)(n), Florida Statutes and applicable State Board of Education Rules or applicable federal law.

  • Infrastructure Improvements The design, redevelopment and construction and completion of certain infrastructure improvements, including sewer, stormwater, electrical and water main improvements, along with other similar improvements.

  • Commercial Operation Date Testing and Modifications Prior to the Commercial Operation Date, the Connecting Transmission Owner shall test the Connecting Transmission Owner’s Attachment Facilities and System Upgrade Facilities and System Deliverability Upgrades and Developer shall test the Large Generating Facility and the Developer Attachment Facilities to ensure their safe and reliable operation. Similar testing may be required after initial operation. Developer and Connecting Transmission Owner shall each make any modifications to its facilities that are found to be necessary as a result of such testing. Developer shall bear the cost of all such testing and modifications. Developer shall generate test energy at the Large Generating Facility only if it has arranged for the injection of such test energy in accordance with NYISO procedures.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract.

  • School Improvement Plan As permitted under IC § 20-10.2-3-1.5, the Charter shall serve as the Charter School's strategic and continuous school improvement and achievement plan (hereafter, the "School Improvement Plan"). To the extent that IC § 20-10.2 applies to the Charter in its function as the School Improvement Plan, the Organizer shall comply with the requirements under IC § 20-10.2.
