Common use of Proportionate Leave on Termination Clause in Contracts

Proportionate Leave on Termination. Where an employee has given five working days or more continuous service, inclusive of any day off as prescribed by clauses 27 or 30 of this award (excluding overtime), and either leaves employment or the employee’s employment is terminated by the employer the employee shall be paid one-twelfth of an ordinary week’s wages in respect of each completed five working days of continuous service with the current employer for which leave has not been granted or paid for in accordance with this award.

Where an employee has given five working days or more If after 4 week's continuous service, inclusive of any day off as prescribed by clauses 27 or 30 of this award (excluding overtime), and either a full time employee leaves their employment or the employee’s their employment is terminated by the employer Company, the employee shall be paid one-twelfth at their ordinary rate of an ordinary week’s wages wage for 2.92 hours at the same rate in respect of each completed five working days week of continuous service, the service with the current employer for being service in respect of which leave has not been granted or paid for in accordance with this awardhereunder. A part time employee shall be entitled to equivalent pro-rata annual leave.
