Common use of Proportionate Leave on Termination Clause in Contracts

Proportionate Leave on Termination. (a) If after one months continuous service in any qualifying 12 month period an employee leaves the employer’s employment or such employee’s employment is terminated, the employee will be paid pro rata leave at the rate of 1/12 of the annual leave for which such employee would be eligible for each completed month of service in respect of which such employee has not been granted annual leave.

(a) If If, after one months month's continuous service in any qualifying 12 month period twelve monthly period, an employee leaves the employer’s employment his or such employee’s her employment, or his or her employment is terminatedterminated by the employer through no fault of the employee, the employee will shall be paid pro rata leave at the rate 4.33 hours in respect of 1/12 of the annual leave for which such employee would be eligible for each completed month week of continuous service being service in respect of which such employee leave has not been granted granted. Pro rata annual leaveleave may be available after six (6) months continuous employment. Annual leave loading as prescribed in paragraph 31.7 shall apply to proportionate leave on termination.
