Protection of Equipment. The Borrower agrees to take all reasonable precautions, as directed by the Lender, or in the absence of such directions, in accordance with sound practices and procedures, to safeguard and protect the above referenced equipment, as well as each and every one of the Lender’s interests therein, for as long as said equipment is in the custody and possession of the Borrower and for as long as this agreement is in force and effect. The borrower further agrees to return said equipment to lender in substantially the same condition as at the time of the Borrower’s taking possession, reasonable wear and tear to the equipment being excepted. Borrower further agrees to obtain and maintain adequate insurance on the equipment to enable the replacement of the equipment in the event of loss or destruction.
Protection of Equipment. The Tenant shall protect from damage all of the heating and air-conditioning apparatus, water, gas and drain pipes, water closets, sinks and accessories thereof in or about the Premises and keep same free from all obstructions that might prevent their free working and give to the Landlord prompt written notice of any accident to or defects in same or any of their accessories. Any damage resulting from misuse or failure to protect same shall be the sole responsibility of the Tenant. The Tenant specifically undertakes to install and maintain at its sole cost and expense, fire extinguishers and such other fire protection equipment as is deemed reasonably necessary or desirable by the Landlord or any governmental or insurance body.
Protection of Equipment. 16.01 Tenant shall protect from damage all the heating and air-conditioning apparatus, water, gas and drain pipes, water closets, sinks and accessories thereof in and about the Premises and keep same free from all obstructions that might prevent their free working and give to Landlord prompt written notice of any accident to or defects in same or any of their accessories. Protection of Equipment. The Contractor shall maintain and administer a sound business program for ensuring the proper use, maintenance, repair, protection, insurance and preservation of all state equipment and/or property.
Protection of Equipment. The Contractor shall take necessary precautions to protect all floors, windows, partition glass, shades, blinds, hardware and lighting fixtures from damages. The Contractor shall be held responsible for any such damage and shall, at the Department’s option, either repair all damage and perform all work or reimburse the Department for the costs of such repair.
Protection of Equipment. Confidential or Proprietary Programs and Information. The Fund agrees to use the equipment, computer programs and other information supplied by the Custodian under this Agreement solely for its own internal use and benefit and not for resale or other transfer or disposition to, or use by or for the benefit of, any other person or organization without the prior written approval of the Custodian. The Fund acknowledges that the data bases, computer programs, screen formats, screen designs, report formats, interactive design techniques, and other information furnished to the Fund by the Custodian constitute copyrighted trade secrets or proprietary information of substantial value to the Custodian. Such data bases, programs and other information are collectively referred to below as "Proprietary Information". The Fund agrees that it shall treat all Proprietary Information as proprietary to the Custodian and that it shall not divulge any Proprietary Information to any person or organization except as expressly permitted hereunder. Without limiting the foregoing, the Fund agrees for itself and its employees and agents:
(1) to use such programs and data bases (i) solely on the Custodian's computers, (ii) solely from equipment at Fund locations agreed to between the Fund and the Custodian and (iii) solely in accordance with the Custodian's applicable user documentation;
(2) to use equipment supplied by the Custodian solely with programs supplied by the Custodian and no other programs or software;
(3) to refrain from copying or duplicating in any way (other than in the normal course of performing processing on Custodian's computers) any part of any Proprietary Information, provided, however, that the Fund may copy or duplicate Proprietary Information to the extent incorporated in any computer generated print-out or other written report containing Customer Data for internal use consistent with this Agreement but only to the extent necessary to copy or duplicate such Customer Data;
(4) to refrain from obtaining unauthorized access to any programs, data or other information not owned by the Fund, and if such access is accidentally obtained, to respect and safeguard the same as Proprietary Information;
(5) to refrain from causing or allowing information transmitted from the Custodian's computer to the Fund's terminals to be retransmitted to another computer, terminal or other device;
(6) that the Fund shall have access to only those authorized transactions as agreed to ...
Protection of Equipment. The risk of loss of the equipment shall pass from Company to Customer upon delivery of the equipment to the Job Site on the Load In Date and continue through the Load Out Date. Customer shall be required to obtain and maintain, at Customer’s sole cost and expense, up to and including the Load Out Date, a proper security force (“Security”) to ensure protection and security of all equipment from loss, theft and/or damage. If Customer fails to procure proper Security, then Company shall have the option, but not the obligation, to hire its own Security at Customer's sole cost and expense. Customer hereby assumes and shall bear the entire risk of loss and damage to the equipment from any and every cause whatsoever except for any damage to the equipment directly caused by Company’s employees.
Protection of Equipment. (a) Protect conduit and wireway openings against the entrance of foreign matter by means of plugs or caps.
(b) Fixtures, materials, equipment, or devices damaged prior to final acceptance of the Work shall be restored to their original condition or replaced by the Contractor.
Protection of Equipment. 17.01 The Tenant shall protect from damage and make all necessary repairs and replacements to the heating, ventilating and air-conditioning apparatus, water, gas and drain pipes, water closets, sinks and accessories thereof in and about the Premises and keep same free from all obstructions that might prevent their free working and shall give to the Landlord prompt written notice of any accident to or defects in same or any of their accessories. On the Commencement Date, Landlord shall deliver the heating, ventilating and air-conditioning apparatus, water, gas and drain pipes, water closets, sinks and accessories in or serving the Premises in a good state of repair and in proper working condition.
Protection of Equipment. 6.1 If WAIHI FARM & INDUSTRIAL leaves Equipment at the Client’s Site in performing its Services, or it hires Equipment to a Client, and all or some of the Equipment is stolen, lost, damaged or destroyed then any costs incurred in repairing, maintaining or replacing the Equipment (as applicable) shall be at the Client’s expense. Any replacement of Equipment is to be undertaken on a like-for-like basis.
