Public Safety Facility. ASU and the City may mutually agree upon a public safety facility (planned to be a fire station, but may also be a police sub-station or a combination thereof) location, up to two (2) acres in size, within the AFDPA within three (3) years of the Effective Date of this Agreement. Upon mutual agreement of the location of the public safety facility, the Parties will enter into a separate agreement jointly defining a development schedule and a City funding source for the public safety facility within the following five (5) years. Construction of the public safety facility must be completed within thirteen (13) years of the effective date of this Agreement. If a development schedule for the public safety facility has not been completed within eight (8) years of the effective date this Agreement or if construction of the public safety facility is not completed within thirteen (13) years of the effective date of this Agreement, then the designated property will be made available for commercial development. Any real property conveyed by ASU to the City for such purpose will only be used for a public safety facility, unless otherwise agreed to by ASU. The public safety facility will be reviewed and approved by the Novus architectural review committee. Within three (3) years of the Effective Date the parties will agree upon the real property to be conveyed to the City under this subsection, final approval of any agreement conveying the property will be subject to approval by the Arizona Board of Regents. Such agreement will also include an offset to the assessment costs, set forth in Section 4.10 above, based upon a mutually agreed upon valuation of the property and discount rate for a net present value calculation. Any agreement under this subsection shall survive termination pursuant to section 5.5 of this Agreement 4.11

Public Safety Facility. YVHA shall dedicate to the City and to the SSAFPD a 1.2-2.0 acre site for a public safety facility with the size and layout determined as provided in Paragraph 7.D.2 and generally in the location shown on Exhibit “B”. YVHA shall dedicate the site in the initial plat of the first phase of development. In the event YVHA elects to modify the development plan and the initial plat of the first phase of development is not the neighborhood closest to US Highway 40, YVHA shall nevertheless record whatever plat is necessary to create the public safety building parcel with vehicular access and utilities and shall construct utilities and paved access to the lot line prior to dedication.

  • Site Safety Buyer shall comply with all federal, state, and local safety regulations and standards applicable to the Site and to the Equipment on which Siemens will perform the Services. Siemens shall not be obligated to commence or perform Services unless Buyer’s Site complies with all applicable safety requirements. In the event Buyer’s Site safety is non- compliant, Siemens may suspend the Services until such time as Buyer corrects the non-compliance.
