Quality of Service Commitment.  If, during the first thirty (30) calendar days after installation, you notify MegaPath in writing (to the street address or e-mail address indicated below) that you are not satisfied with MegaPath’s Duet Voice and Data Service and request in that notice that your service be discontinued, we will terminate your Service Order and relieve you from the remaining term of your service commitment.  If you decide to cancel under this guaranty, you will not be responsible for any of the early termination fees that you would otherwise be responsible for under the terms of your service agreement and MegaPath will refund the one-time service activation fees and associated equipment purchase price you have paid to MegaPath, subject to satisfaction of the other applicable terms of this SLA, below. This refund may be provided, in whole or in part, by way of credit to Customer’s account or issuance of a check to Customer for the subject amount, in MegaPath’s discretion. Time to Restore Service Commitment  Our Commitment: The time to restore service for a Duet Voice and Data Service access circuit is four (4) hours. The “time to restore” begins on the date and time when Customer reported the service impairment to MegaPath, via MegaPath’s authorized “trouble ticketing system,” together with all information necessary for MegaPath to respond to the trouble ticket, and ends upon confirmation by MegaPath to Customer that service has been restored (in each case, based upon MegaPath’s records). This period shall be extended to account for any period of time spent by MegaPath traveling to Customer’s premises or waiting for a response, availability, action or access to the premises from Customer in furtherance of the repair effort, and any period of time during which a “force majeure” event (see below) affecting service or the repair process has occurred and is continuing. This Time to Restore Service Commitment does not include resolution of any Customer premises inside wiring or CPE issues.  Your Remedy: If MegaPath fails to meet the above Time to Restore Service Commitment, Customer may request a service credit equal to one (1) day’s contracted, monthly recurring service charge for the Duet Voice and Data Service. Customer is eligible for an additional day’s service credit for each subsequent 24-hour period (commencing upon expiration of the initial time-to-restore period) that the circuit remains unavailable.   • Quality of Service Contractor shall perform its services with care, skill, and diligence, in accordance with the applicable professional standards currently recognized by such profession, and shall be responsible for the professional quality, technical accuracy, completeness, and coordination of all reports, designs, drawings, plans, information, specifications, and/or other items and services furnished under this Agreement. Contractor shall, without additional compensation, correct or revise any errors or deficiencies immediately upon discovery in its reports, drawings, specifications, designs, and/or other related items or services.

  • Quality of Services (a) The Consultant shall be responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and other services furnished pursuant to this Agreement.

  • Originality of Services Except as to standard generic details, Consultant agrees that all technologies, formulae, procedures, processes, methods, writings, ideas, dialogue, compositions, recordings, teleplays and video productions prepared for, written for, or submitted to the District and/or used in connection with this Agreement, shall be wholly original to Consultant and shall not be copied in whole or in part from any other source, except that submitted to Consultant by District as a basis for such services.

  • Availability of Service We will use reasonable efforts to make the Service available for your use on a continuous basis. The Service may be unavailable for short periods of time for regular or emergency system maintenance. We will endeavor to have our scheduled maintenance occur during non-peak hours. In addition, accessibility to the Service may be interrupted because of conditions beyond our control, including outages in Internet, cellular or other communications availability. We will use diligent efforts to re-establish the Services as promptly as possible. We do not promise the Service will always be available for your use. We may elect to discontinue this Service at any time. If we choose to discontinue the Service, we will provide you with reasonable notice in advance of that fact. We reserve the right at all times to take actions to protect our systems and information, including denial of access to users of the Service.

  • Unavailability of Services You understand and agree that the Services may at times be temporarily unavailable due to system maintenance or technical difficulties. In the event any of the services included in our Mobile Banking Services are unavailable, you acknowledge that you can deposit an original check at our branches or through ATM that accepts your deposit, or by mail.

  • Responsibility for Quality of Materials and Installation Contractor acknowledges that he has full, total, and complete responsibility for providing materials, labor, and all other items necessary for providing the level of quality specified in the Contract Documents. He agrees that this responsibility is indivisible, non-delegable, non- transferable, and not diminished by any inspections provided by the Design Professional or his consulting engineers, nor by any inspections provided by the Owner. In recognition of this, Contractor will prepare for submission and review by the Design Professional, a written program describing the efforts that will be taken to insure the proper quality level is achieved. The program shall be submitted prior to the issuance of a Proceed Order.

  • Confidentiality of Services All services performed by Contractor, and any sub- contractor(s) if applicable, including but not limited to all drafts, data, information, correspondence, proposals, reports of any nature, estimates compiled or composed by Contractor, are for the sole use of City, its agents, and employees. Neither the documents nor their contents shall be released by Contractor or any subcontractor to any third party without the prior written consent of City. This provision does not apply to information that: (1) was publicly known, or otherwise known to Contractor, at the time it was disclosed to Contractor by City; (2) subsequently becomes publicly known through no act or omission of Contractor; or (3) otherwise becomes known to Contractor other than through disclosure by City.

  • Quality of Work Consultant agrees that all Services performed under this Agreement will conform to the specifications of the College, be free from errors, and be of professional quality according to applicable industry standards. Upon notice by the College, Consultant will promptly correct any defects without charge to the College unless the request is considered new work by both parties.

  • Portability of Service An employee hired by the Hospital with recent and related experience may claim consideration for such experience at the time of hiring on a form to be supplied by the Hospital. Any such claim shall be accompanied by verification of previous related experience. The Hospital shall then evaluate such experience during the probationary period following hiring. Where in the opinion of the Hospital such experience is determined to be relevant, the employee shall be slotted in that step of the wage progression consistent with one (1) year's service for every one (1) year of related experience in the classification upon completion of the employee's probationary period. It is understood and agreed that the foregoing shall not constitute a violation of the wage schedule under the collective agreement."
