Ratcheting. To the extent that CLEC requests Qwest to commingle a UNE or a UNE Combination with one or more facilities or services that CLEC has obtained at wholesale from Qwest pursuant to a method other than unbundling under Section 251(c)(3) of the Act, Qwest will not be required to xxxx that wholesale circuit at multiple rates, otherwise known as ratcheting. Such commingling will not affect the prices of UNEs or UNE Combinations involved.

Ratcheting. 7.1 To the extent that CLEC requests Qwest to commingle a UNE or a UNE Combination with one or more facilities or services that CLEC has obtained at wholesale from Qwest pursuant to a method other than unbundling under Section 251(c)(3) of the Act, Qwest will not be required to ratchet individual facilities. For purposes of this Amendment, ratcheting means a pricing mechanism that involves billing a single circuit at multiple rates to develop a single blended rate. Thus, Qwest is not required to implement any changes to its billing or other systems necessary to xxxx a single circuit at multiple rates (e.g., a DS3 circuit at rates based on special access services and UNEs) in order to charge CLEC a single, blended rate. Such commingling will not affect the prices of UNEs or UNE Combinations involved.

A decision by the arbitrator shall be rendered in writing within a reasonable time, not to exceed ten (10) days after the conclusion of the hearing. The decision by the arbitrator shall be final and binding upon the parties; provided, however, that the arbitrator shall not have the authority to alter or amend the provisions of this AGREEMENT in any way. The reasonable expenses and fees of the arbitrator shall be borne equally by the parties.
