Rebates, Discounts and Allowances. Franchisee authorizes Franchisor to collect all available rebates, discounts and allowances (RDA) from vendors or others with whom Franchisee does business, provided that, in Franchisor’s reasonable business judgment, it is appropriate to collect them. Franchisor shall place all collected RDAs in either the National Marketing fund or in a separate account and shall apply all such funds for purposes of subsidizing the cost of franchisee conventions, meetings and incentive programs. Franchisee authorizes Franchisor to commingle Franchisee's RDA funds with those received on account of business conducted by other franchisees. Franchisor is authorized to pay from the collected RDA funds any taxes and assessments payable on account of having received the funds and a reasonable portion of the administrative and marketing costs of securing, managing and disbursing such funds. Franchisor will provide an un-audited annual accounting as to the aggregate amount of RDA funds collected and their use and application by general category, which accounting will be prepared within ninety days following the end of Franchisor's fiscal year and will be provided to Franchisee upon written request. Franchisee acknowledges and agrees that each such accounting is a Trade Secret and shall be treated as such according to this Agreement. Except as herein specifically provided, Franchisee waives all compliance with the Uniform Trust Accounting Act and related or similar laws to the broadest extent permitted by law.

  • Discounts, Rebates and Refunds Cash discounts obtained on payments made by the Construction Manager shall accrue to the Owner. Trade discounts, rebated, refunds, and amounts received from sales of surplus materials and equipment shall accrue to the Owner and the Construction Manager shall make provisions so they can be secured.

  • Wages and Allowances The wages contained herein at Clause 7 – Wages Schedules will be in lieu of the wages described in other Appendices of this Agreement but are to be read in conjunction with Clause 4 of this Appendix. The allowances will apply as contained in Appendix A unless mentioned otherwise in this Appendix.

  • Cash Allowances (a) The Guaranteed Price includes cash allowances as set out in the Specifications which shall be expended as Owner directs through the Consultant by a Cash Allowance Disbursement Authorization.

  • Meal Allowances Employees assigned to be in travel status between the employee's temporary or permanent work station and a field assignment shall be reimbursed for the actual cost of meals including a reasonable gratuity. Employees must meet the following conditions to be eligible for meal reimbursement:

  • Tool Allowances The Employer shall supply all tools and equipment required to perform the work.

  • PAYMENT OF WAGES AND ALLOWANCES 25.01 The Employer shall pay salaries and wages bi-weekly in accordance with Schedule “A” attached hereto and forming part of this Agreement. On each pay day, each Employee shall be provided with an itemized statement of his/her wages and deductions. Deficiencies in an Employee’s pay in excess of $50.00 shall be paid by way of an advance within three (3) days of advising the Employer.

  • Vehicle Allowances Vehicle allowances for all distances traveled on Employer business shall be paid to employees required to use their own vehicles in the performance of their duties. The allowance shall cover distance to and from the employee's place of residence up to a total maximum of thirty-two (32) kilometers, only when the employee is required to have his vehicle at work for use in the performance of his duties. The vehicle allowance shall be thirty-eight (38) cents per kilometer. Ownership of a vehicle will not be considered a condition of employment.

  • Aid Allowance An employee who has been appointed by the Employer and trained to render first aid and who is the current holder of appropriate first aid qualifications such as a certificate from the St. Xxxx's Ambulance or similar body shall be paid weekly an allowance as detailed in Appendix A. The Employer will always appoint the appropriate number of First Aid Officers as required by relevant legislation and Code of Practice.

  • Shift Allowances (a) An Employee whilst on afternoon or night shift must be paid for such shift 15% more than the Employee’s ordinary rate.

  • Overtime Meal Allowances (a) An Employee who is required to work a minimum of two and one-half (2½) hours overtime before or after his/her scheduled hours of work, shall be provided with a meal or shall be reimbursed nine dollars ($9.00). A meal break of one-half (½) hour with pay shall be given at the overtime rate. This section shall not apply to an Employee who is on travel status which entitles him/her to claim for lodging and/or meals.
