Acknowledgment of this organizational name does not indicate, imply or denote recognition by the Board of any teachers not employed by the Board. C. The Board agrees not to negotiate with any other organization other than the association for the duration of this Agreement. Section 2.2 The term "teacher" when used hereinafter will refer to all professional employees represented by the Association in the negotiating unit as well as defined above. References to singular includes plural.
Section 2.3 It is agreed that the Bargaining Unit members set forth in Section 2.1 will have the sole responsibility for performing the duties normally associated with this position. With the following exceptions, these duties will not be performed by any other classified administrators. When a new job is created which requires state teacher certification and which person or service that is not clearly included within a member of this Bargaining Unit: Should the bargaining unit District engage either an outside agency or the association president will be promptly notified. At the request services of the associationan individual on a sub- contracting (non-employee) basis, the parties will discuss the proper classification of the new position.
B. The designation of Huron Valley Education Associationit may do so only if a qualified current Bargaining Unit member, MEA/NEAwhether on layoff or actively working, is understood unable or unwilling to be provide the official name service. The Bargaining Unit member will not provide the service if doing so creates a conflict with his/her existing assignment. The Bargaining Unit member may not provide the service if doing so required more than a full-time assignment. An individual hired will become a member of the Bargaining Agent Unit if he/she is hired to replace a teacher on leave or one who was terminated/laid off, or if the assignment is for the employees listed in a semester or more. General education classroom teachers, including counselors, media specialists, and support teachers, duties will not be sub-contracted. Special education support services other than those funded by federal programs will not be sub-contracted for an extended period of time. (Extended period of time is one (1) year or more.) 6

C. 2.4 The Board District agrees not to negotiate with any other individual teacher or any teachers' organization other than the association Association for the duration of this Agreement. .
Section 2.5 Nothing contained herein shall prevent the Board and/or administration from hearing and discussing concerns with will be construed to restrict or deny to any member(s) teacher any rights he/she may have under any law of constitutional provision of the bargaining unit providedState of Michigan or the United States of America.
Section 2.6 The individual contract executed between each teacher and the District is subject to the terms and conditions of this Agreement, however, and it is intended that this Article take precedence over and govern the Board and/or Administration shall not engage in individual contract and the individual contract is expressly conditioned upon this Article. C. The Board agrees not University of Massachusetts Amherst, and University of Massachusetts Amherst Fellows and Trainees whose duties and responsibilities are substantially similar to negotiate with any other organization other than the association those of TOs, TAs, RAs, PAs, ARDs, or Interns, for the duration purpose of good faith negotiations with the Administration on matters relating to employment policies and practices. The subjects of negotiation shall explicitly exclude matters relating to academic policies. The bargaining unit shall also include graduate student employees of the President’s Office working in the above positions at the University of Massachusetts Amherst campus who are employed by the Xxxxxxx Institute. Performing work required to fulfill a degree requirement shall not be reason for exclusion from the provisions of this Agreement. The Administration will report to GEO within thirty days any new job classifications to which graduate students are appointed and will determine if the job classification will be included under this Agreement. If there is disagreement between GEO and the Administration concerning the inclusion or exclusion, then the two parties shall meet to negotiate. The Administration will not make any agreement with any group for the purpose of undermining GEO. The Union and the University agree to convene a working group by July 1, 2018 consisting of three members appointed by the university and three appointed by the union. The working group will place some number of fellows who receive funding from outside sources to the extent allowed by their individual funding sources in any negotiations with these the GEO bargaining unit. The working group may include classes of fellows in the bargaining unit members unless said members are empowered on a rolling basis, to be completed by September 1, 2019. The working group will also be authorized to extend similar benefits and protections to those externally funded fellows whose funding sources do so by not permit inclusion in the associationunit.

Despite the incorporated title of Supervisors, it is no way intended at the time of the signing of this Agreement or in the future, that any teachers not employed employee in this school district in a Supervisory position other than those appointed with the specific title of Department Supervisor or Supervisor/Teacher of (specialized curriculum area) shall now be or ever in the future be represented by this Association for collective negotiations.
B. Unless otherwise indicated, the term "Department Supervisors," when used hereafter in this Agreement shall refer to all professional employees represented by the BoardAssociation in the negotiating unit as above defined, and references to male Department Supervisors shall include female Department Supervisors.
C. The Board agrees not to negotiate with any other organization other than the association for the duration provisions of this AgreementAgreement apply only to Department Supervisors under contract as defined in the recognition clause above. The Huron Valley Schools Board of Education, hereinafter known as the "Board" hereby recognizes the Huron Valley Education Association, MEA/NEA, hereinafter known as the "association" Association as the exclusive bargaining representative as defined in Section Eleven (11) of Act 379, Public Acts of 1965 as amended for all certified personnel holding positions requiring certification whether under contract, on leave, employed or to be employed by the Board including: classroom teachers, alternative education and English as a Second Language (ESL/Bilingual) K-12 teachers, elementary music, elementary art, elementary physical education, shared time teachers permanent substitutes, term substitutes, guidance counselors, media specialists, learning specialists, school psychologists, social workers, teacher consultants, speech and language pathologists, teachers of the physically handicapped, teachers of the deaf, teachers of the blind, teachers of the homebound, teachers of the hospitalized, teachers of the educable mentally impaired, teachers of the emotionally impaired, teachers of the learning disabled, work study coordinators, pre-school classroom teachers and counselors holding permanentpre- school teachers Early Childhood Program (tuition based), lifeoccupational therapists, continuing physical therapists, resource room coordinators, resource room teachers, curriculum resource consultants, school nurses, language development consultants, , and provisional certificates issued by the Michigan Department of Education, including Librarians, Media Specialists, Music Teachers, Social Workers, Special Education Teachers, Resource Room Teachers, Speech Correction Teachers, School Psychologists, Reading Teachers, Certified Title I Teachers, Certified Student Activities Coordinators, Head Start Teachers, Young Parents Coordinator, full-time Vocational Education Teachers, Career Technical Education Facilitator, Staff Development Program Coordinator, Gifted and Talented Program Coordinator, Student Assistance Coordinator, Facilitator for Staff Development, Young Parents Program Teachers all other certified personnel who work fourteen (14directly with children and all non-certified or non-endorsed personnel who are hired consistent with MCL 380.1233(b) hours or more who work directly with children. There shall be excluded from the bargaining unit the following: per weekdiem substitutes, accounting/business office personnel, clerical personnel, secretarial personnel, cafeteria personnel, technical personnel, maintenance personnel, custodial personnel, transportation personnel adult education and community education employees, and Alternative Education Program Teachers who work fourteen (14) hours or more per week; excluding all temporary teachers teacher aides/ paraprofessionals. In addition, there shall be excluded supervisory and others not specifically aforementionedadministrative personnel, all Supervisors such as: Superintendent, Deputy Superintendent, Assistant SuperintendentSuperintendents, Executive Directors, Administrative Assistants, Administrative InternsPrincipals, Assistant Principals, Coordinators of Curriculum, Director of Educational Projects Libraries, Director of Continuing Education and assistants, Area Coordinators, Director of Special Education and assistants, Special Education Supervisors, Director of Maintenance and Custodial Operations, Supervisor of New Construction and all area Community School Personnel while serving other personnel who spend more than one-half of their time in that capacityadministrative and supervisory activities. The term "teacher" when used hereinafter in the Agreement, Athletic Director, Central Office Administrators, Principals, Assistant Principals as well as other classified administrators. When a new job is created which requires state teacher certification and which is not clearly included within shall refer to all employees represented by the Association in the bargaining unit the association president will be promptly notified. Nothing contained herein shall prevent the Board and/or administration from hearing and discussing concerns with work heretofore performed by any member(s) of the certificated employee bargaining unit providedof the school district, howeverexcept for advertised extra duty assignments as per provision of Article II, that Section E of this Agreement. The parties to this Agreement recognize that the duties and counselors holding permanent, life, continuing and provisional certificates issued work performed by the Michigan Department of Education, including Librarians, Media Specialists, Music Teachers, Social Workers, Special Education Teachers, Resource Room Teachers, Speech Correction Teachers, School Psychologists, Reading Teachers, Certified Title I Teachers, Certified Student Activities Coordinators, Head Start Teachers, Young Parents Coordinator, full-time Vocational Education Teachers, Career Technical Education Facilitator, Staff Development Program Coordinator, Gifted and Talented Program Coordinator, Student Assistance Coordinator, Facilitator for Staff Development, Young Parents Program Teachers who work fourteen (14) hours or more per week, and Alternative Education Program Teachers who work fourteen (14) hours or more per week; excluding all temporary teachers and others not specifically aforementioned, all Supervisors such as: Superintendent, Assistant Superintendent, Administrative Assistants, Administrative Interns, Director of Educational Projects and all area Community School Personnel while serving certificated employees in that capacity, Athletic Director, Central Office Administrators, Principals, Assistant Principals as well as other classified administrators. When a new job is created which requires state teacher certification and which is not clearly included within the bargaining unit described above, with the association president will exception of special education services, shall be promptly notified. At the request of the association, the parties will discuss the proper classification of the new position.
B. The designation of Huron Valley Education Association, MEA/NEA, is understood to performed only by unit members and shall not be the official name of the Bargaining Agent for the employees listed in Section A. of this Article. Acknowledgment of this organizational name does not indicate, imply subcontracted or denote recognition by the Board of any teachers not employed by the Board.
C. The Board agrees not to negotiate with any other organization other than the association for the duration of this Agreement. Nothing contained herein shall prevent the Board and/or administration from hearing and discussing concerns with any member(s) otherwise transferred out of the bargaining unit providedunit. In addition, howeverthe administrative position of Learning Director may assume counseling duties as part of their assigned duties. Learning Directors will not serve as primary evaluators. As of September 2004, that the Board and/or Administration current counselors shall not engage be displaced for the sole purpose of employing Learning Directors.
D. The Board of Trustees agrees to not initiate a Charter School in any negotiations with these bargaining unit members unless said members of the following sites without prior approval from the Association: Ceres High School, Central Valley High School, Argus/ Endeavor High School, Xxxxxx Xxxxxx Junior High, Xxxxx Xxxxxx Junior High School, Xxx Xxxxxxx Junior High School, Xxxxxxx Elementary School, Beaver Elementary School, Xxxxxxx Xxxxxx Elementary School, Xxxxxxx Elementary School, Xxx Xxxxx Elementary School, Hidahl Elementary School, La Xxxx Elementary School, Xxxxx Elementary School, Sinclear Elementary School, Xxx Xxxxxx Elementary School, Xxxxxxxx Xxxxx Elementary School, Xxxxxx Xxxxx Elementary School, and Westport Elementary School. RECOGNITION. A. 1. The Huron Valley Schools Board SPS recognizes the SEA to be the sole and exclusive bargaining agent for the paraprofessionals in the bargaining unit and to be responsible for representing the interest of Educationall such employees, hereinafter known pursuant to Chapter 41.56 RCW, Public Employees Collective Bargaining Act, as amended.
2. Throughout the remainder of this Agreement, the employees covered hereunder will be referred to collectively as the "Boardbargaining unit" hereby recognizes and individually as "member" or as "employee."
3. The employees in the Huron Valley Education Association, MEA/NEA, hereinafter known as bargaining unit shall consist of employees who work in positions listed in Appendix B of this Agreement. 4. Casual/temporary employment shall not be used in lieu of Act 379filling a vacant represented position or to avoid creating a represented position. Casual/temporary employees shall not be used to fill vacant bargaining unit positions unless there are no qualified classified substitutes available. In the event that casual/temporary employees are used in lieu of classified substitutes represented by SEA, Public Acts the SPS shall notify the SEA of 1965 such use.
5. The rights and privileges afforded the Association as amended for all K-12 teachers and counselors holding permanent, life, continuing and provisional certificates issued specifically enumerated in this Agreement shall not be granted to any competing labor organization or any organization seeking to represent or otherwise communicate with employees represented by the Michigan Department Association.
6. Whenever the SPS modifies the job title or the job description of Educationany position listed in Appendix B, including Librariansit shall furnish the text of such change to the SEA and Appendix B shall be considered as thereby amended to that extent. Should the SPS desire to delete a modified or discontinued job title from Appendix B, Media Specialistsit shall so advise the SEA in writing giving the reasons. If the SEA concurs, Music Teachers, Social Workers, Special Education Teachers, Resource Room Teachers, Speech Correction Teachers, School Psychologists, Reading Teachers, Certified Title I Teachers, Certified Student Activities Coordinators, Head Start Teachers, Young Parents Coordinator, fullit shall confirm this in writing and Appendix B shall be considered as thereby amended to that extent. a. The positions to be filled under such title are to be regular positions.
b. The positions to be filled are not confidential, as defined in Item 5 above.
c. The positions to be filled are not funded categorically under a program which has regulations either prohibiting such addition to the unit or which otherwise establish a separate community of interest among the association president will employees to be promptly notifiedadded. At If the request of the associationSEA concurs, it shall confirm this in writing and Appendix B shall be considered as thereby amended to that extent. E. Each year, the District shall make reasonable effort to place qualified bargaining unit members, who apply, into all advertised extra‐duty assignments before hiring any persons outside the unit to fill such assignments.
F. The Board agrees of Education shall not subcontract out to negotiate with private parties, individuals or businesses, any other organization other than the association for the duration of this Agreement. Nothing contained herein shall prevent the Board and/or administration from hearing and discussing concerns with work heretofore performed by any member(s) of the certificated employee bargaining unit providedof the school district, howeverexcept for advertised extra duty assignments as per provision of Article II, that Section E of this Agreement. The Superintendent and Association Executive Director may, by mutual agreement, in writing, allow a needed certificated employee position to be filled temporarily from outside the Board and/or Administration shall not engage bargaining unit, on a full‐time or part‐time basis, at a mutually agreeable hourly rate, to provide needed emergency services for students, for no more than sixty (60) calendar days maximum, during which time the District will make every reasonable effort to hire a qualified certificated employee to fill the job position in any negotiations with these bargaining unit members unless said members are empowered to do so by the associationquestion.

B. The designation of Huron Valley Education Association, MEA/NEA, is understood to be the official name of the Bargaining Agent for the employees listed in Section A. of this Article. Acknowledgment of this organizational name does not indicate, imply or denote recognition by the Board of any teachers not employed by the Board.
C. The Board agrees not to negotiate with any other organization other than the association for the duration of this Agreement. Nothing contained herein shall prevent the Board and/or administration from hearing and discussing concerns with any member(s) Recreation Public Works Superintendent Sewage Plant Superintendent Water Superintendent Road Superintendent Tax Collector Supervising Mechanic Building SubCode Official Any of the bargaining unit providedtitles that use bi-lingual and/or interpreter shall remain in the bargaining unit.
B. All managerial executives, howeverconfidential employees, non-supervisory employees, police employees, casual employees, and all other employees of the Employer are excluded from this bargaining unit.
C. In the event that the Employer decides to create and/or use a new title, that the Board and/or Administration title shall not engage in any negotiations with these be added to this bargaining unit members unless said members are empowered it is clearly that of a non-supervisory, managerial, or confidential nature. If the Employer creates a new position, prior to do so by filling it, the associationEmployer shall notify the Union of the Employer's views concerning inclusion or exclusion in the negotiation unit and if included in the unit, the salary range that the Employer intends to assign to the position. If the Union disagrees, within two (2) weeks after the Union's receipt of the Employer's notification, the Union may advise of its intent to negotiate. Any dispute as to inclusion or exclusion (i.e., unit composition), if not resolved through face to face negotiations, may be submitted to PERC for disposition pursuant to clarification of unit proceedings. Any dispute as to the salary range to be assigned to the position, if not resolved through face to face negotiations, may be submitted to PERC for disposition pursuant to impasse procedures (i.e., mediation and fact-finding).
D. If the Union, at any time, wishes to advise the Employer of its views regarding the creation or abolition of positions or the criteria governing the filling of positions or any other non-negotiable subjects pertaining to managerial prerogatives in the area of hiring, staffing, and the like, the Union may write to the Employer in care of the City Administrator. The Employer shall review the Union's written input, and, if the Employer deems it appropriate, shall invite Union representatives to discuss the matter at a Employer meeting it being understood that in all cases, the Employer shall provide written response to the Union.

It is agreed that the Employer, if required by any governmental entity in order to get or keep a grant, has the right to conduct background checks for pre-hires.
SECTION 4.
SECTION 5. Due to the programs and grants administered by the Health Department, temporary employees, students/interns, and volunteers may perform work that is also performed by employees covered by this agreement. Temporary employees may be used up to six (6) months to cover for leaves of absence. The Employer may also contract with outside agencies to perform work similar to the work performed by employees covered by this Agreement. The rights granted to the Employer under this section shall not result in the displacement of bargaining unit provided, however, that the Board and/or Administration shall not engage in any negotiations with these employees or positions. C. The Board agrees not to negotiate with any other organization other than the association for the duration of this Agreement. Acknowledgment of this organizational name does not indicateProject Assistants (PA), imply or denote recognition by the Board of any teachers not Assistant Residence Directors (ARD), and Graduate Interns employed by the Board.
C. The Board agrees not University of Massachusetts Amherst, and University of Massachusetts Amherst Fellows and Trainees whose duties and responsibilities are substantially similar to negotiate with any other organization other than the association those of TOs, TAs, RAs, PAs, ARDs, or Interns, for the duration purpose of good faith negotiations with the Administration on matters relating to employment policies and practices. The subjects of negotiation shall explicitly exclude matters relating to academic policies. The bargaining unit shall also include graduate student employees of the President’s Office working in the above positions at the University of Massachusetts Amherst campus who are employed by the Xxxxxxx Institute. Performing work required to fulfill a degree requirement shall not be reason for exclusion from the provisions of this Agreement. Section 5 Should the Employer revive the abolished positions of Account Clerk, Behavior Support Specialist, Custodial Aide, Habilitation Coordinator, Licensed Practical Nurse, Truck Driver, Work Procurement Specialist, or Workshop Specialist, those positions shall be considered part of the bargaining unit.
Section 6 Except for operational emergencies, training, where insufficient or qualified bargaining unit employees are not readily available or in short-term circumstances which do not significantly impact bargaining unit rights, non-bargaining unit employees will not perform bargaining unit work. Bargaining unit employees shall not perform non-bargaining unit work, except in operational emergencies as determined by leadership.
Section 7 The Union recognizes the association president will be promptly notified. At the request right of the associationEmployer to make changes in job descriptions for reasons such as operational necessity, technological change or for matters of efficiency or economy. Thirty (30) days prior to making any change in a bargaining unit job description, the Employer will notify the Union of its intent in writing. The notice will contain the proposed changes, the reasons for such changes and a sample of the proposed job description. The Union will notify the Employer in writing of its intent to meet, discuss and/or bargain the effects of the changes within ten (10) days of the receipt of the Employer’s notice. RECOGNITION. A. The Huron Valley Schools 1. Pursuant to the Certification of Representation issued by the State Employment Relations Board of Educationthe State of Ohio in Case No. 88-REP-06-0134, hereinafter known as the "Board" hereby Library recognizes the Huron Valley Education Association, MEAOhio Association of Public School Employees OAPSE/NEA, hereinafter known as the "association" AFSCME AFL-CIO and OAPSE Local No. 15 as the exclusive bargaining representative as defined agent of its employees in Section Eleven a unit described below with respect to wages, hours, and terms and conditions of employment.
2. The bargaining unit shall consist of the following classifications: Specialist (11) of Act 379Art Gallery Curator), Public Acts of 1965 as amended for Librarian (non-supervisory employees), Custodian, Clerk, Clerk-Specialist, Library Technical Assistant, Library Associate, and Page.
3. 4. Should there be any question concerning placement of Educational Projects and all area Community School Personnel while serving in that capacity, Athletic Director, Central Office Administrators, Principals, Assistant Principals as well as other classified administrators. When a new position or classification established by management in the bargaining unit, or its possible exclusion, the Union and the Library shall meet to discuss said placement. A dispute over bargaining unit status shall be resolved in accordance with the procedures of the State Employment Relations Board. Nothing in this section shall limit the sole right of management to establish new jobs and the requirements of all jobs. The Library and the Union acknowledge that there is a duty to negotiate any wages and conditions of employment for a position that is placed in the bargaining unit.
5. A job description shall be provided any new employee at the time of employment, and to any employee who transfers and/or is created which requires state teacher certification and which promoted to a new classification at the time of transfer or promotion. Job descriptions will be written for any classification that is not clearly currently described. Employees within a classification will have the opportunity to review and comment on any new or revised job description prior to its implementation. The Union shall be provided with job descriptions for each classification covered by this agreement. Nothing in this section shall limit the Library's sole right to establish new classifications and determine what requirements shall be included within the bargaining unit the association president will be promptly notified. At the request of the association, the parties will discuss the proper classification of the new positionin each classification.
B. The designation of Huron Valley Education Association6. It is mutually agreed that, MEA/NEA, is understood to be in the official name of the Bargaining Agent for the employees listed in Section A. of this Article. Acknowledgment of this organizational name does not indicate, imply or denote recognition by the Board of any teachers not employed by the Board.
C. The Board agrees not to negotiate with any other organization other than the association for the duration application of this Agreement. Section 5 Should the Employer revive the abolished positions of Account Clerk, Behavior Support Specialist, Custodial Aide, Habilitation Coordinator, Licensed Practical Nurse, Truck Driver, Work Procurement Specialist, or Workshop Specialist, those positions shall be considered part of the bargaining unit.
Section 6 Except for operational emergencies, training, where insufficient or qualified bargaining unit employees are not readily available or in short-term circumstances which do not significantly impact bargaining unit rights, non-bargaining unit employees will not perform bargaining unit work. Bargaining unit employees shall not perform non-bargaining unit work, except in operational emergencies as determined by leadership.
Section 7 The Union recognizes the association president will be promptly notified. At the request right of the associationEmployer to make changes in job descriptions for reasons such as operational necessity, technological change or for matters of efficiency or economy. Thirty (30) days prior to making any change in a bargaining unit job description, the Employer will notify the Union of its intent in writing. The notice will contain the proposed changes, the reasons for such changes and a sample of the proposed job description. The Union will notify the Employer in writing of its intent to meet, discuss and/or bargain the effects of the changes within ten (10) days of the receipt of the Employer’s notice. In the case of an emergency, the Employer may implement such changes with written notice to the Union, and the parties will discuss meet, if requested by the proper classification Union, within ten (10) days of the new position.
