Recruitment of Personnel. During the term of this Agreement and for a period of one (1) year thereafter, neither Party shall solicit the employment of any employee of the other with whom such Party has had contact in connection with the relationship arising under this Agreement. Neither a response to an employment inquiry first initiated by a prospective employee, nor the publishing of employment advertisements in public or industry media, nor contacts initiated by search firms who have not been requested to contact the specific persons, will be a violation of this Section 12.4.
Recruitment of Personnel. During the initial and any subsequent term of this License and for a period of one (1) year thereafter, neither QCSI nor CLIENT will hire, employ or contract with directly or indirectly any key employee(s) of the other for a period of one hundred twenty (120) days following termination of such employee's employment, without the prior written consent of the other.
Recruitment of Personnel. 16.1. Each Party undertakes not to attempt to solicit or procure the services of staff employed by the other party who are involved in the performance of this Contract during the course of this Contract and for a period of six months thereafter without the written permission of the other party.
16.2. The Client agrees to pay Carbon Footprint a 'finderʼs fee' should the Client recruit a Carbon Footprint Consultant to a paid employment position within two years of the conclusion of any work on behalf of the Client by that Consultant or of that Consultant being introduced to the Client whichever is the later.
16.3. In respect of this clause, the definition of 'Consultant' shall include all Carbon Footprint employees and Associates that are involved in the provision of services to the Client under this or any other Contract.
16.4. The 'finderʼs fee' shall be 30% of the first year's gross remuneration payable by the Client or its Associates to the Consultant.
Recruitment of Personnel. The contractor shall not recruit any personnel of any category from those who are already employed by other agencies working within the state.
Recruitment of Personnel. Executive agrees that he will not, while this Agreement is in effect and for a period of two years thereafter, directly or indirectly, individually or in concert with other persons, aid or endeavor to solicit or induce
(a) then remaining employees of DBMS or its affiliates, or agents, licensees, franchisees, or consultants performing regularly contracted work for DBMS or its affiliates, to leave their employment or independent contractor positions to accept employment or contractor positions with another person or entity, or
(b) then customers of DBMS to obtain from another person or entity products or services similar to or competitive with the products or services then sold or provided by DBMS.
(c) The geographic area of the restrictions set forth in this Article 8.2 and its preceding subsections shall be the United States and its territories and possessions, together with any other countries in which DBMS shall have been actively promoting its services or the licensing or franchise of the right to promote its services within the 12 month period prior to termination of the employment of Executive.
Recruitment of Personnel. The selection of additional personnel will remain at the sole discretion of the Company, it being understood that the Company will give equal opportunity to all candidates sent by the Union as is given to any candidate from other sources. Those candidates for employment will be given orientation training. Orientation days, up to ten (10), will be counted toward seniority. New employees attending orientation shall be paid the starting rate for their classification. It is agreed that in the event of an increase in the number of orientation days in excess of ten (10), said increased days shall be counted in the probationary period.
Recruitment of Personnel. All employees of the Company shall be recruited and employed on the basis of labor contracts and the collective labor agreement, in accordance with the Laws of Vietnam and the Company’s personnel regulations promulgated by the Members’ Council. Vietnamese citizens are given priority in recruitment by the Company. Where high levels of management and technical skills are required and which are not available in Vietnam, the Company may recruit foreign experts provided a training program shall be formulated for local replacement in the future. The Company shall apply social security, heath insurance and safe working environment for the sake of its employees in compliance with the Laws of Vietnam.

Recruitment of Personnel. For one year after the expiration of this Agreement, Client and CCS shall not directly or indirectly solicit for employment the other Party’s employees or agents, or hire or engage such employee or agent without the prior written consent of the other Party. Notwithstanding this prohibition, should one Party hire the employee or agent of the other within this timeframe without the prior written consent of the other Party, the hiring Party shall pay the other Party as liquidated damages for the loss of such employee or agent an amount equal to twice the hired employee’s annual compensation previously paid by the non-hiring party.
Recruitment of Personnel. The recruitment of and the conclusion of employment agreements on behalf of Kibali with persons of requisite skill and ability to enable Kibali generally to carry on its mining activities and specifically to implement all Approved Programmes, it being acknowledged that the Operator or any Affiliate of the Operator shall be entitled to second to Kibali such expatriate personnel as may, in the reasonable opinion of the Operator, be required in respect of the efficient carrying out of the mining activities of Kibali and the Approved Programmes, provided that, in the case of the Mine, the Project and Kibali, the Operator shall give preference to citizens of and/or permanent residents in the State who shall have equal qualifications, ability and experience in relation to such positions of employment.
