Red Flag Rules. The Transfer Agent has developed and maintains a program with respect to applicable identity theft regulatory requirements (the “Red Flag Rules”). The Transfer Agent’s program includes polices, procedures and controls which are reasonably designed to detect violations of the Red Flag Rules. The Transfer Agent agrees to report any such violations to the Fund in accordance with the Red Flag Rules and to provide annual certification to the Fund with respect to its program and controls.”
Red Flag Rules. All Parties agree to establish, maintain, and abide by reasonable policies and procedures designed to detect, prevent, and mitigate the risk of identity theft related to Eligible Households through the administration of LIHWA.
Red Flag Rules. If applicable to BUSINESS ASSOCIATE, BUSINESS ASSOCIATE shall be responsible for implementation of an Identity Theft Monitoring Policy and procedure to protect Personal Information under the Federal Trade Commission regulations known as the “Red Flag Rules.”
Red Flag Rules. Contractor acknowledges that FAMU has adopted an Identity Theft Prevention Program as required under 16 C.F.R. Part 681 for certain covered accounts that may be assessed in accordance with this agreement. Accordingly, Contractor will conduct its activities in accordance with reasonable policies and procedures to detect, prevent and mitigate the risk of identity theft.
Red Flag Rules. Each Seller, Guarantor and Servicer shall at all times comply with the Red Flag Rules and maintain a Red Flag Rules Program in compliance with the Red Flag Rules and shall deliver to the Buyer (i) quarterly certifications, in form and substance reasonably satisfactory to the Buyer to be delivered in connection with each quarterly Financial Officer’s Compliance Certificate, attesting to their compliance with the Red Flag Rules and the Red Flag Rules Program, and (ii) copies of any audits, examination findings or reports received or delivered by it to or from any regulatory authority regarding its compliance with the Red Flag Rules promptly after receipt or delivery.
Red Flag Rules. If applicable to SC, SC shall be responsible for implementation of an Identity Theft Monitoring Policy and procedure to protect Personal Information under the Federal Trade Commission regulations known as the “Red Flag Rules.”
Red Flag Rules. Red Flag Rules shall mean the Identity Theft Red Flag Rules promulgated under the Fair and Accurate Credit Transactions Act of 2003, found at 16 CFR Part 681.
Red Flag Rules. When a credit bureau report is pulled using the Software the consumer’s Red Flag “Score” will be accessed. If the Red Flag “Score” indicates dealership action is required pursuant to Red Flag Rule regulations a message will pop-up in the software informing you further investigation regarding the consumer’s identity is required, and you can initiate access to the Red Flag Exam which consists of “out of wallet” The Software will instantly and automatically screen all of your consumers against the OFAC list when you initially enter each consumer’s name in the Software. If there is no possible match for the consumer’s name (No Hit) on the OFAC list a note stating this search result will be permanently entered in the customer notes. If there is a possible match for the consumer’s name on the OFAC list (Hit) a pop up will appear on Software screen advising the Dealership of the required action.

Red Flag Rules. Contractor shall comply with the Red Flag Rules and Guidelines. In compliance with the Red Flag Rules and Guidelines, Contractor shall develop, implement, and maintain, written identity theft prevention programs, which provide for the identification, detection, and response to Red Flags.
