(a) Cancellation by Charterer: If Charterer cancels the charter, SF Bay Boat Cruises’ refund policy is as follows: 1) if Charterer cancels the charter with more than four weeks from charter date then the Charterer is entitled to a 100% refund of any deposits, balance and additional payments; 2) if cancellation is requested within seven days of the charter date then the Charterer will be refunded 50% of any deposits, balance and additional payments; 3) if cancellation is requested within 48 (forty-eight) hours of the charter date then the Charterer forfeits all deposits, balance and additional payments and any deposits, balance and additional payments retained by SF Bay Boat Cruises are non-liquidated damages.
