Regulatory Compliance and License Termination. Each Party and the Sheriff covenant and agree to provide all requested information, at such Party’s expense, and deliver to the filing Party all information necessary for the filing Party’s FCC Reports and FAA Reports at least sixty (60) days prior to the required filing date. Each Party and the Sheriff hereby agree to cooperate with each other in the preparation and filing of any and all FCC Reports and FAA Reports required to be made and filed by another Party. As the County and Sheriff have, as the case may be, all construction, operation, management, administration, maintenance, repair, upkeep and operational responsibilities with respect to the System, all as provided in the Participation Agreement, County and Sheriff further covenant and agree to comply with all applicable FCC and FAA Regulations and decisions related to the several FCC Licenses and the Shared Spectrums, including, but not limited to: (i) the FCC’s requirements for the use of radio frequencies or spectrums; (ii) the FCC’s environmental compliance requirements; (iii) the FCC and FAA Regulations governing the construction, operation, maintenance, marking and lighting of antenna structures; (iv) applicable technical and interference rules of the FCC and FAA, and (v) the FCC’s qualification and eligibility rules. As of the date of this Agreement, County has provided the License Holders with a certificate, in substantially the form of Exhibit D attached hereto, warranting to the License Holders eligibility to share the Shared Spectrums. Any and all governmental notifications, permits and licenses required for the connection, operation and/or servicing of Subscriber Equipment shall be procured and maintained by County’s expense and risk, except to the extent otherwise provided in this Agreement. As required by FCC Regulations, if the Term of this Agreement extends beyond the then current expiration date of any one or more of such FCC Licenses and the FCC License or Licenses are not renewed or are terminated, this Agreement will expire when the underlying FCC License or Licenses expire or are terminated.

  • Research Use Reporting To assure adherence to NIH GDS Policy, the PI agrees to provide annual Progress Updates as part of the annual Project Renewal or Project Close-out processes, prior to the expiration of the one (1) year data access period. The PI who is seeking Renewal or Close-out of a project agree to complete the appropriate online forms and provide specific information such as how the data have been used, including publications or presentations that resulted from the use of the requested dataset(s), a summary of any plans for future research use (if the PI is seeking renewal), any violations of the terms of access described within this Agreement and the implemented remediation, and information on any downstream intellectual property generated from the data. The PI also may include general comments regarding suggestions for improving the data access process in general. Information provided in the progress updates helps NIH evaluate program activities and may be considered by the NIH GDS governance committees as part of NIH’s effort to provide ongoing stewardship of data sharing activities subject to the NIH GDS Policy.

  • Information Technology Accessibility Standards Any information technology related products or services purchased, used or maintained through this Grant must be compatible with the principles and goals contained in the Electronic and Information Technology Accessibility Standards adopted by the Architectural and Transportation Barriers Compliance Board under Section 508 of the federal Rehabilitation Act of 1973 (29 U.S.C. §794d), as amended.   • Financial Viability and Regulatory Compliance 4.6.1 The Contractor warrants and represents that its corporate entity is in good standing with all applicable federal, state, and local licensing authorities and that it possesses all requisite licenses to perform the services required by this contract.   • Public Posting of Approved Users’ Research Use Statement The PI agrees that information about themselves and the approved research use will be posted publicly on the dbGaP website. The information includes the PI’s name and Requester, project name, Research Use Statement, and a Non-Technical Summary of the Research Use Statement. In addition, and if applicable, this information may include the Cloud Computing Use Statement and name of the CSP or PCS. Citations of publications resulting from the use of controlled-access datasets obtained through this DAR may also be posted on the dbGaP website.
